| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 48.02(d), Penal Code, is amended to read |

| 11 | 11 | | as follows: |
|---|
| 12 | 12 | | (d) An offense under [A violation of] this section is a |
|---|
| 13 | 13 | | state jail felony [Class A misdemeanor]. |
|---|
| 14 | 14 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 15 | 15 | | to an offense committed on or after the effective date of this Act. |
|---|
| 16 | 16 | | An offense committed before the effective date of this Act is |
|---|
| 17 | 17 | | governed by the law in effect when the offense was committed, and |
|---|
| 18 | 18 | | the former law is continued in effect for that purpose. For purposes |
|---|
| 19 | 19 | | of this section, an offense was committed before the effective date |
|---|
| 20 | 20 | | of this Act if any element of the offense occurred before that date. |
|---|
| 21 | 21 | | SECTION 3. This Act takes effect September 1, 2023. |
