55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the completion of sexual harassment prevention training
88 and ethics training to register as a lobbyist.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 305.005(f), Government Code, is amended
1111 to read as follows:
1212 (f) The registration must be written and verified and must
1313 contain:
1414 (1) the registrant's full name and address;
1515 (2) the registrant's normal business, business phone
1616 number, and business address;
1717 (3) the full name and address of each person:
1818 (A) who reimburses, retains, or employs the
1919 registrant to communicate directly with a member of the legislative
2020 or executive branch to influence legislation or administrative
2121 action; and
2222 (B) on whose behalf the registrant has
2323 communicated directly with a member of the legislative or executive
2424 branch to influence legislation or administrative action;
2525 (4) the subject matter of the legislation or of the
2626 administrative action that is the subject of the registrant's
2727 direct communication with a member of the legislative or executive
2828 branch and, if applicable, the docket number or other
2929 administrative designation of the administrative action;
3030 (5) for each person employed or retained by the
3131 registrant for the purpose of assisting in direct communication
3232 with a member of the legislative or executive branch to influence
3333 legislation or administrative action:
3434 (A) the full name, business address, and
3535 occupation of the person; and
3636 (B) the subject matter of the legislation or of
3737 the administrative action to which the person's activities
3838 reportable under this section were related and, if applicable, the
3939 docket number or other administrative designation of the
4040 administrative action; [and]
4141 (6) the amount of compensation or reimbursement paid
4242 by each person who reimburses, retains, or employs the registrant
4343 for the purpose of communicating directly with a member of the
4444 legislative or executive branch or on whose behalf the registrant
4545 communicates directly with a member of the legislative or executive
4646 branch;
4747 (7) a certificate evidencing the registrant's
4848 completion of a sexual harassment prevention training course in the
4949 previous two years, as required by Section 305.0052; and
5050 (8) a certificate evidencing the registrant's
5151 completion of an ethics training course in the previous two years,
5252 as required by Section 305.0053.
5353 SECTION 2. Subchapter A, Chapter 305, Government Code, is
5454 amended by adding Sections 305.0052 and 305.0053 to read as
5555 follows:
5656 Sec. 305.0052. SEXUAL HARASSMENT PREVENTION TRAINING. (a)
5757 Each individual required to register under this chapter shall every
5858 two years:
5959 (1) attend a sexual harassment prevention training
6060 course approved by the commission; and
6161 (2) submit to the commission a certificate evidencing
6262 completion of the course.
6363 (b) The certificate of completion must be in a form approved
6464 by the commission.
6565 (c) The commission shall adopt rules as necessary to
6666 implement this section.
6767 Sec. 305.0053. ETHICS TRAINING. (a) Each individual
6868 required to register under this chapter shall every two years:
6969 (1) attend an ethics training course approved by the
7070 commission; and
7171 (2) submit to the commission a certificate evidencing
7272 completion of the course.
7373 (b) The certificate of completion must be in a form approved
7474 by the commission.
7575 (c) The commission shall adopt rules as necessary to
7676 implement this section.
7777 SECTION 3. Not later than December 1, 2023, the Texas Ethics
7878 Commission shall adopt rules as required by Sections 305.0052 and
7979 305.0053, Government Code, as added by this Act.
8080 SECTION 4. Section 305.005, Government Code, as amended by
8181 this Act, applies only to a registration required to be filed under
8282 that section on or after January 1, 2024.
8383 SECTION 5. This Act takes effect September 1, 2023.
