| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 48.105(b), Education Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (b) At least 90 [55] percent of the funds allocated under |
|---|
| 13 | 13 | | this section must be used in providing bilingual education or |
|---|
| 14 | 14 | | special language programs under Subchapter B, Chapter 29. A |
|---|
| 15 | 15 | | district's bilingual education or special language allocation may |
|---|
| 16 | 16 | | be used only for program and student evaluation, instructional |
|---|
| 17 | 17 | | materials and equipment, staff development, supplemental staff |
|---|
| 18 | 18 | | expenses, salary supplements for teachers, incremental costs |
|---|
| 19 | 19 | | associated with providing smaller class sizes, and other supplies |
|---|
| 20 | 20 | | required for quality instruction. |

| 21 | 21 | | SECTION 2. This Act takes effect September 1, 2023. |
