66 AN ACT
77 relating to depression screenings for certain women in county jail
88 or in the custody of the Texas Department of Criminal Justice.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 501, Government Code, is
1111 amended by adding Section 501.0655 to read as follows:
1212 Sec. 501.0655. DEPRESSION SCREENING FOR PREGNANT INMATE.
1313 The department shall ensure that each inmate who is pregnant or has
1414 given birth in the preceding year is screened for depression:
1515 (1) once each trimester during the pregnancy;
1616 (2) once during the six-week period after giving
1717 birth; and
1818 (3) at 6 and 12 months after giving birth.
1919 SECTION 2. Section 511.009(a), Government Code, is amended
2020 to read as follows:
2121 (a) The commission shall:
2222 (1) adopt reasonable rules and procedures
2323 establishing minimum standards for the construction, equipment,
2424 maintenance, and operation of county jails;
2525 (2) adopt reasonable rules and procedures
2626 establishing minimum standards for the custody, care, and treatment
2727 of prisoners;
2828 (3) adopt reasonable rules establishing minimum
2929 standards for the number of jail supervisory personnel and for
3030 programs and services to meet the needs of prisoners;
3131 (4) adopt reasonable rules and procedures
3232 establishing minimum requirements for programs of rehabilitation,
3333 education, and recreation in county jails;
3434 (5) regularly review the commission's rules and
3535 procedures and revise, amend, or change the rules and procedures if
3636 necessary;
3737 (6) provide to local government officials
3838 consultation on and technical assistance for county jails;
3939 (7) review and comment on plans for the construction
4040 and major modification or renovation of county jails;
4141 (8) require that the sheriff and commissioners of each
4242 county submit to the commission, on a form prescribed by the
4343 commission, an annual report on the conditions in each county jail
4444 within their jurisdiction, including all information necessary to
4545 determine compliance with state law, commission orders, and the
4646 rules adopted under this chapter;
4747 (9) review the reports submitted under Subdivision (8)
4848 and require commission employees to inspect county jails regularly
4949 to ensure compliance with state law, commission orders, and rules
5050 and procedures adopted under this chapter;
5151 (10) adopt a classification system to assist sheriffs
5252 and judges in determining which defendants are low-risk and
5353 consequently suitable participants in a county jail work release
5454 program under Article 42.034, Code of Criminal Procedure;
5555 (11) adopt rules relating to requirements for
5656 segregation of classes of inmates and to capacities for county
5757 jails;
5858 (12) adopt a policy for gathering and distributing to
5959 jails under the commission's jurisdiction information regarding:
6060 (A) common issues concerning jail
6161 administration;
6262 (B) examples of successful strategies for
6363 maintaining compliance with state law and the rules, standards, and
6464 procedures of the commission; and
6565 (C) solutions to operational challenges for
6666 jails;
6767 (13) report to the Texas Correctional Office on
6868 Offenders with Medical or Mental Impairments on a jail's compliance
6969 with Article 16.22, Code of Criminal Procedure;
7070 (14) adopt reasonable rules and procedures
7171 establishing minimum requirements for a county jail to:
7272 (A) determine if a prisoner is pregnant;
7373 (B) ensure that the jail's health services plan
7474 addresses:
7575 (i) medical care, including obstetrical and
7676 gynecological care;
7777 (ii) [,] mental health care, including a
7878 requirement that each prisoner who is pregnant or has given birth in
7979 the preceding year be screened for depression:
8080 (a) once each trimester during the
8181 pregnancy;
8282 (b) once during the six-week period
8383 after giving birth; and
8484 (c) at 6 and 12 months after giving
8585 birth;
8686 (iii) nutritional requirements; [,] and
8787 (iv) any special housing or work assignment
8888 needs for prisoners who are known or determined to be pregnant; and
8989 (C) identify when a pregnant prisoner is in labor
9090 and provide appropriate care to the prisoner, including promptly
9191 transporting the prisoner to a local hospital;
9292 (15) provide guidelines to sheriffs regarding
9393 contracts between a sheriff and another entity for the provision of
9494 food services to or the operation of a commissary in a jail under
9595 the commission's jurisdiction, including specific provisions
9696 regarding conflicts of interest and avoiding the appearance of
9797 impropriety;
9898 (16) adopt reasonable rules and procedures
9999 establishing minimum standards for prisoner visitation that
100100 provide each prisoner at a county jail with a minimum of two
101101 in-person, noncontact visitation periods per week of at least 20
102102 minutes duration each;
103103 (17) require the sheriff of each county to:
104104 (A) investigate and verify the veteran status of
105105 each prisoner by using data made available from the Veterans
106106 Reentry Search Service (VRSS) operated by the United States
107107 Department of Veterans Affairs or a similar service; and
108108 (B) use the data described by Paragraph (A) to
109109 assist prisoners who are veterans in applying for federal benefits
110110 or compensation for which the prisoners may be eligible under a
111111 program administered by the United States Department of Veterans
112112 Affairs;
113113 (18) adopt reasonable rules and procedures regarding
114114 visitation of a prisoner at a county jail by a guardian, as defined
115115 by Section 1002.012, Estates Code, that:
116116 (A) allow visitation by a guardian to the same
117117 extent as the prisoner's next of kin, including placing the
118118 guardian on the prisoner's approved visitors list on the guardian's
119119 request and providing the guardian access to the prisoner during a
120120 facility's standard visitation hours if the prisoner is otherwise
121121 eligible to receive visitors; and
122122 (B) require the guardian to provide the sheriff
123123 with letters of guardianship issued as provided by Section
124124 1106.001, Estates Code, before being allowed to visit the prisoner;
125125 (19) adopt reasonable rules and procedures to ensure
126126 the safety of prisoners, including rules and procedures that
127127 require a county jail to:
128128 (A) give prisoners the ability to access a mental
129129 health professional at the jail or through a telemental health
130130 service 24 hours a day or, if a mental health professional is not at
131131 the county jail at the time, then require the jail to use all
132132 reasonable efforts to arrange for the inmate to have access to a
133133 mental health professional within a reasonable time;
134134 (B) give prisoners the ability to access a health
135135 professional at the jail or through a telehealth service 24 hours a
136136 day or, if a health professional is unavailable at the jail or
137137 through a telehealth service, provide for a prisoner to be
138138 transported to access a health professional; and
139139 (C) if funding is available under Section
140140 511.019, install automated electronic sensors or cameras to ensure
141141 accurate and timely in-person checks of cells or groups of cells
142142 confining at-risk individuals; and
143143 (20) adopt reasonable rules and procedures
144144 establishing minimum standards for the quantity and quality of
145145 feminine hygiene products, including tampons in regular and large
146146 sizes and menstrual pads with wings in regular and large sizes,
147147 provided to a female prisoner.
148148 SECTION 3. Not later than December 1, 2023, the Commission
149149 on Jail Standards shall adopt the rules and procedures required by
150150 Section 511.009(a), Government Code, as amended by this Act.
151151 SECTION 4. This Act takes effect September 1, 2023.
