55 relating to the eligibility of certain political subdivisions to
66 receive certain financial assistance administered by the Texas
77 Water Development Board.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 15.001, Water Code, is amended by adding
1010 Subdivision (14) to read as follows:
1111 (14) "Rural political subdivision" means:
1212 (A) a nonprofit water supply or sewer service
1313 corporation created and operating under Chapter 67 of this code or a
1414 district or authority created under Section 52, Article III, or
1515 Section 59, Article XVI, Texas Constitution, no part of the service
1616 area of which is located in an urban area with a population of more
1717 than 50,000;
1818 (B) a municipality:
1919 (i) with a population of 10,000 or less part
2020 of the service area of which is located in an urban area with a
2121 population of 50,000 or more; or
2222 (ii) located wholly in a county in which no
2323 urban area has a population of more than 50,000;
2424 (C) a county in which no urban area has a
2525 population of more than 50,000; or
2626 (D) an entity that:
2727 (i) is a nonprofit water supply or sewer
2828 service corporation created and operating under Chapter 67 of this
2929 code, a district or authority created under Section 52, Article
3030 III, or Section 59, Article XVI, Texas Constitution, a
3131 municipality, county, or other political subdivision of the state,
3232 or an interstate compact commission to which the state is a party;
3333 and
3434 (ii) demonstrates in a manner satisfactory
3535 to the board that the entity is rural or the area to be served by the
3636 project is a wholly rural area despite not otherwise qualifying
3737 under Paragraph (A), (B), or (C).
3838 SECTION 2. Section 15.434(b), Water Code, is amended to
3939 read as follows:
4040 (b) Of the money disbursed from the fund during the
4141 five-year period between the adoption of a state water plan and the
4242 adoption of a new plan, the board shall undertake to apply not less
4343 than:
4444 (1) 10 percent to support projects described by
4545 Section 15.435 that are for:
4646 (A) rural political subdivisions [as defined by
4747 Section 15.992]; or
4848 (B) agricultural water conservation; and
4949 (2) 20 percent to support projects described by
5050 Section 15.435, including agricultural irrigation projects, that
5151 are designed for water conservation or reuse.
5252 SECTION 3. Section 17.001, Water Code, is amended by adding
5353 Subdivision (26) to read as follows:
5454 (26) "Rural political subdivision" has the meaning
5555 assigned by Section 15.001.
5656 SECTION 4. Section 17.9615(a), Water Code, is amended to
5757 read as follows:
5858 (a) The board may direct the comptroller to transfer amounts
5959 from the financial assistance account to the rural water assistance
6060 fund to provide financial assistance to rural political
6161 subdivisions under this subchapter for the purposes provided in
6262 Section 15.994.
6363 SECTION 5. Section 15.992(4), Water Code, is repealed.
6464 SECTION 6. This Act takes effect September 1, 2023.
