5	5	relating to the eligibility of certain political subdivisions to
6	6	receive certain financial assistance administered by the Texas
7	7	Water Development Board.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. Section 15.001, Water Code, is amended by adding
10	10	Subdivision (14) to read as follows:
11	11	(14) "Rural political subdivision" means:
12	12	(A) a nonprofit water supply or sewer service
13	13	corporation created and operating under Chapter 67 of this code or a
14	14	district or authority created under Section 52, Article III, or
15	15	Section 59, Article XVI, Texas Constitution, no part of the service
16	16	area of which is located in an urban area with a population of more
17	17	than 50,000;
18	18	(B) a municipality:
19	19	(i) with a population of 10,000 or less part
20	20	of the service area of which is located in an urban area with a
21	21	population of 50,000 or more; or
22	22	(ii) located wholly in a county in which no
23	23	urban area has a population of more than 50,000;
24	24	(C) a county in which no urban area has a
25	25	population of more than 50,000; or
26	26	(D) an entity that:
27	27	(i) is a nonprofit water supply or sewer
28	28	service corporation created and operating under Chapter 67 of this
29	29	code, a district or authority created under Section 52, Article
30	30	III, or Section 59, Article XVI, Texas Constitution, a
31	31	municipality, county, or other political subdivision of the state,
32	32	or an interstate compact commission to which the state is a party;
33	33	and
34	34	(ii) demonstrates in a manner satisfactory
35	35	to the board that the entity is rural or the area to be served by the
36	36	project is a wholly rural area despite not otherwise qualifying
37	37	under Paragraph (A), (B), or (C).
38	38	SECTION 2. Section 15.434(b), Water Code, is amended to
39	39	read as follows:
40	40	(b) Of the money disbursed from the fund during the
41	41	five-year period between the adoption of a state water plan and the
42	42	adoption of a new plan, the board shall undertake to apply not less
43	43	than:
44	44	(1) 10 percent to support projects described by
45	45	Section 15.435 that are for:
46	46	(A) rural political subdivisions [as defined by
47	47	Section 15.992]; or
48	48	(B) agricultural water conservation; and
49	49	(2) 20 percent to support projects described by
50	50	Section 15.435, including agricultural irrigation projects, that
51	51	are designed for water conservation or reuse.
52	52	SECTION 3. Section 17.001, Water Code, is amended by adding
53	53	Subdivision (26) to read as follows:
54	54	(26) "Rural political subdivision" has the meaning
55	55	assigned by Section 15.001.
56	56	SECTION 4. Section 17.9615(a), Water Code, is amended to
57	57	read as follows:
58	58	(a) The board may direct the comptroller to transfer amounts
59	59	from the financial assistance account to the rural water assistance
60	60	fund to provide financial assistance to rural political
61	61	subdivisions under this subchapter for the purposes provided in
62	62	Section 15.994.
63	63	SECTION 5. Section 15.992(4), Water Code, is repealed.
64	64	SECTION 6. This Act takes effect September 1, 2023.
