7	7	relating to providing information to undergraduate students
8	8	regarding certain fixed or flat tuition rates provided by certain
9	9	public institutions of higher education.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Section 54.016, Education Code, is amended by
12	12	adding Subsection (d) to read as follows:
13	13	(d) A general academic teaching institution that offers a
14	14	fixed tuition rate program under this section shall provide
15	15	information explaining the effect of the program on the calculation
16	16	of a student's cost per credit hour, including the institution's
17	17	current fixed tuition rate, and clearly describing the amount of
18	18	tuition a student would pay for varying course loads covered by the
19	19	program:
20	20	(1) to each transferring undergraduate student, at the
21	21	time the student is offered the opportunity to participate in the
22	22	institution's fixed tuition rate program;
23	23	(2) for a student enrolled in the institution's fixed
24	24	tuition rate program, in materials or correspondence provided to
25	25	the student each time the student registers for a semester or other
26	26	term and in each tuition billing statement;
27	27	(3) on the institution's Internet website; and
28	28	(4) in any financial aid information provided to
29	29	students.
30	30	SECTION 2. Section 54.017, Education Code, is amended by
31	31	adding Subsection (h) to read as follows:
32	32	(h) An institution to which this section applies shall
33	33	provide information explaining the effect of the fixed tuition
34	34	price plan on the calculation of a student's cost per credit hour,
35	35	including the institution's current fixed tuition rate, and clearly
36	36	describing the amount of tuition a student would pay for varying
37	37	course loads covered by the plan:
38	38	(1) to each entering undergraduate student, at the
39	39	time the student is offered the opportunity to participate in the
40	40	institution's fixed tuition price plan;
41	41	(2) for a student enrolled in the institution's fixed
42	42	tuition price plan, in materials or correspondence provided to the
43	43	student each time the student registers for a semester or other term
44	44	and in each tuition billing statement;
45	45	(3) on the institution's Internet website; and
46	46	(4) in any financial aid information provided to
47	47	students.
48	48	SECTION 3. Subchapter A, Chapter 54, Education Code, is
49	49	amended by adding Section 54.018 to read as follows:
50	50	Sec. 54.018. FLAT-RATE TUITION PLAN. (a) In this section,
51	51	"institution of higher education" has the meaning assigned by
52	52	Section 61.003.
53	53	(b) An institution of higher education that offers a
54	54	flat-rate tuition plan under which the institution charges a
55	55	student for a specified number of credit hours regardless of the
56	56	number of credit hours in which the student enrolls shall provide
57	57	information explaining the effect of the flat-rate tuition plan on
58	58	the calculation of a student's cost per credit hour, including the
59	59	institution's current flat rate of tuition, and clearly describing
60	60	the amount of tuition a student would pay for varying course loads
61	61	covered by the plan:
62	62	(1) to each entering undergraduate student;
63	63	(2) in materials or correspondence provided to the
64	64	student each time the student registers for a semester or other term
65	65	and in each tuition billing statement;
66	66	(3) on the institution's Internet website; and
67	67	(4) in any financial aid information provided to
68	68	students.
69	69	SECTION 4. This Act takes effect September 1, 2023.
