55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to providing information to undergraduate students
88 regarding certain fixed or flat tuition rates provided by certain
99 public institutions of higher education.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 54.016, Education Code, is amended by
1212 adding Subsection (d) to read as follows:
1313 (d) A general academic teaching institution that offers a
1414 fixed tuition rate program under this section shall provide
1515 information explaining the effect of the program on the calculation
1616 of a student's cost per credit hour, including the institution's
1717 current fixed tuition rate, and clearly describing the amount of
1818 tuition a student would pay for varying course loads covered by the
1919 program:
2020 (1) to each transferring undergraduate student, at the
2121 time the student is offered the opportunity to participate in the
2222 institution's fixed tuition rate program;
2323 (2) for a student enrolled in the institution's fixed
2424 tuition rate program, in materials or correspondence provided to
2525 the student each time the student registers for a semester or other
2626 term and in each tuition billing statement;
2727 (3) on the institution's Internet website; and
2828 (4) in any financial aid information provided to
2929 students.
3030 SECTION 2. Section 54.017, Education Code, is amended by
3131 adding Subsection (h) to read as follows:
3232 (h) An institution to which this section applies shall
3333 provide information explaining the effect of the fixed tuition
3434 price plan on the calculation of a student's cost per credit hour,
3535 including the institution's current fixed tuition rate, and clearly
3636 describing the amount of tuition a student would pay for varying
3737 course loads covered by the plan:
3838 (1) to each entering undergraduate student, at the
3939 time the student is offered the opportunity to participate in the
4040 institution's fixed tuition price plan;
4141 (2) for a student enrolled in the institution's fixed
4242 tuition price plan, in materials or correspondence provided to the
4343 student each time the student registers for a semester or other term
4444 and in each tuition billing statement;
4545 (3) on the institution's Internet website; and
4646 (4) in any financial aid information provided to
4747 students.
4848 SECTION 3. Subchapter A, Chapter 54, Education Code, is
4949 amended by adding Section 54.018 to read as follows:
5050 Sec. 54.018. FLAT-RATE TUITION PLAN. (a) In this section,
5151 "institution of higher education" has the meaning assigned by
5252 Section 61.003.
5353 (b) An institution of higher education that offers a
5454 flat-rate tuition plan under which the institution charges a
5555 student for a specified number of credit hours regardless of the
5656 number of credit hours in which the student enrolls shall provide
5757 information explaining the effect of the flat-rate tuition plan on
5858 the calculation of a student's cost per credit hour, including the
5959 institution's current flat rate of tuition, and clearly describing
6060 the amount of tuition a student would pay for varying course loads
6161 covered by the plan:
6262 (1) to each entering undergraduate student;
6363 (2) in materials or correspondence provided to the
6464 student each time the student registers for a semester or other term
6565 and in each tuition billing statement;
6666 (3) on the institution's Internet website; and
6767 (4) in any financial aid information provided to
6868 students.
6969 SECTION 4. This Act takes effect September 1, 2023.
