55 AN ACT
66 Relating to special reports of political contributions received by
77 candidates for certain offices.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter C, Chapter 254, Election Code, is
1010 amended by adding Section 254.0645 to read as follows:
1111 Sec. 254.0645. SPECIAL REPORT BY CERTAIN CANDIDATES. (a)
1212 In addition to other reports required by this chapter, the
1313 following candidates shall file additional reports with the
1414 commission during the period beginning January 1 and ending the
1515 ninth day before election day, who accepts during that reporting
1616 period political contributions from one person that in the
1717 aggregate exceed $10,000:
1818 (1) State Board of Education,
1919 (2) State Senator.
2020 (3) State Representative,
2121 (4) County Judge,
2222 (5) County Commissioner, or
2323 (6) District Attorney.
2424 (b) Each report under this section must include:
2525 (1) the amount of each political contribution;
2626 (2) the full name and address of the person making the
2727 political contribution; and
2828 (3) the date each political contribution was made.
2929 (c) A candidate who is required to file a report under this
3030 section shall file the report electronically, by telephonic
3131 facsimile machine, or by hand, in the form required by Section
3232 254.036 not later than:
3333 (1) 5 p.m. of the first business day after the date the
3434 contribution is accepted, if the report is filed by telephonic
3535 facsimile machine or hand; or
3636 (2) midnight of the first business day after the date
3737 the contribution is accepted, if the report is filed
3838 electronically.
3939 (d) A report under this section is not required to be
4040 accompanied by the affidavit required under Section 254.036(h) or
4141 to be submitted on a form prescribed by the commission. A report
4242 under this section that complies with Section 254.036(a) must be
4343 accompanied by an affidavit under Section 254.036(c)(1), unless the
4444 candidate has submitted an affidavit under Section 254.036(c)(1)
4545 with another report filed in connection with the election for which
4646 a report is required under this section.
4747 (e) To the extent of a conflict between this section and
4848 Section 254.036, this section prevails.
4949 SECTION 2. This Act takes effect September 1, 2023.
