| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 502.198(a), Transportation Code, is |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | (a) Except as provided by Sections 502.058, 502.060, |
|---|
| 11 | 11 | | 502.1911, 502.192, 502.356, [and] 502.357, and 502.360 and |
|---|
| 12 | 12 | | Subchapter H, this section applies to all fees collected by a county |
|---|
| 13 | 13 | | assessor-collector under this chapter. |
|---|
| 14 | 14 | | SECTION 2. Subchapter G, Chapter 502, Transportation Code, |
|---|
| 15 | 15 | | is amended by adding Section 502.360 to read as follows: |
|---|
| 16 | 16 | | Sec. 502.360. ADDITIONAL FEE FOR ELECTRIC VEHICLES. (a) In |
|---|
| 17 | 17 | | this section, "electric vehicle" means a motor vehicle that has a |
|---|
| 18 | 18 | | gross weight of 10,000 pounds or less and uses electricity as its |
|---|
| 19 | 19 | | only source of motor power. The term does not include: |
|---|
| 20 | 20 | | (1) an autocycle, as defined by Section 501.008; |
|---|
| 21 | 21 | | (2) a moped, as defined by Section 541.201; |
|---|
| 22 | 22 | | (3) a motorcycle, as defined by Sections 521.001 and |
|---|
| 23 | 23 | | 541.201; or |
|---|
| 24 | 24 | | (4) a neighborhood electric vehicle, as defined by |
|---|
| 25 | 25 | | Section 551.301. |
|---|
| 26 | 26 | | (b) In addition to other fees authorized under this chapter, |
|---|
| 27 | 27 | | at the time of application for registration or renewal of |
|---|
| 28 | 28 | | registration of an electric vehicle, the applicant shall pay an |
|---|
| 29 | 29 | | additional fee of: |
|---|
| 30 | 30 | | (1) $400, for the registration of a new vehicle to |
|---|
| 31 | 31 | | which Section 548.102 applies; or |
|---|
| 32 | 32 | | (2) $200, for the registration or renewal of |
|---|
| 33 | 33 | | registration of a vehicle to which Section 548.101 applies. |
|---|
| 34 | 34 | | (c) Fees collected under this section must be deposited to |
|---|
| 35 | 35 | | the credit of the state highway fund. |
|---|
| 36 | 36 | | (d) The department may adopt rules to administer this |
|---|
| 37 | 37 | | section. |
|---|
| 38 | 38 | | SECTION 3. This Act takes effect September 1, 2023. |
