55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the confidentiality of certain mug shots.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 109.005(a), Business & Commerce Code, is
1010 amended to read as follows:
1111 (a) A business entity may not publish any criminal record
1212 information in the business entity's possession:
1313 (1) with respect to which the business entity has
1414 knowledge or has received notice that:
1515 (A) [(1)] an order of expunction has been issued
1616 under Article 55.02, Code of Criminal Procedure; or
1717 (B) [(2)] an order of nondisclosure of criminal
1818 history record information has been issued under Subchapter E-1,
1919 Chapter 411, Government Code; or
2020 (2) that may not be released to the public under
2121 Section 552.1082, Government Code.
2222 SECTION 2. Subchapter C, Chapter 552, Government Code, is
2323 amended by adding Section 552.1082 to read as follows:
2424 Sec. 552.1082. RELEASE OF MUG SHOTS. (a) In this section,
2525 "mug shot" means an image taken of an individual during the process
2626 of arresting the individual or booking the individual into jail.
2727 (b) A mug shot may not be released to the public, unless:
2828 (1) the individual has been convicted of a criminal
2929 offense, other than an offense described by Subsection (c), based
3030 upon the conduct for which the individual was arrested or
3131 incarcerated at the time the mug shot was taken;
3232 (2) a law enforcement agency releases the mug shot
3333 after determining that:
3434 (A) the individual is:
3535 (i) a fugitive; or
3636 (ii) an imminent threat to another
3737 individual or to public safety; and
3838 (B) releasing the mug shot will assist in
3939 apprehending the individual or reducing or eliminating the threat;
4040 or
4141 (3) a judge orders the release of the mug shot based on
4242 a finding that the release is in furtherance of a legitimate law
4343 enforcement interest.
4444 (c) A mug shot may not be released to the public if the mug
4545 shot was taken in association with an offense for which:
4646 (1) the conviction has been expunged; or
4747 (2) the individual has been fully exonerated.
4848 (d) If an individual was charged with multiple offenses
4949 based upon the conduct for which the individual was arrested or
5050 incarcerated at the time the mug shot was taken, and the individual
5151 was later convicted of one or more of those offenses, the
5252 individual's mug shot may be released to the public unless:
5353 (1) all of the convictions have been expunged; or
5454 (2) the individual has been fully exonerated of all
5555 convictions.
5656 SECTION 3. Section 552.1425(a), Government Code, is amended
5757 to read as follows:
5858 (a) A private entity that compiles and disseminates for
5959 compensation criminal history record information may not compile or
6060 disseminate information:
6161 (1) with respect to which the entity has received
6262 notice that:
6363 (A) [(1)] an order of expunction has been issued
6464 under Article 55.02, Code of Criminal Procedure; or
6565 (B) [(2)] an order of nondisclosure of criminal
6666 history record information has been issued under Subchapter E-1,
6767 Chapter 411; or
6868 (2) that may not be released to the public under
6969 Section 552.1082.
7070 SECTION 4. The change in law made by this Act applies to a
7171 mug shot regardless of the date it was created.
7272 SECTION 5. This Act takes effect immediately if it receives
7373 a vote of two-thirds of all the members elected to each house, as
7474 provided by Section 39, Article III, Texas Constitution. If this
7575 Act does not receive the vote necessary for immediate effect, this
7676 Act takes effect September 1, 2023.
