55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the statewide intellectual and developmental
88 disability coordinating council.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 531, Government Code, is amended by
1111 adding Subchapter M-2 to read as follows:
1212 SUBCHAPTER M-2. STATEWIDE INTELLECTUAL AND DEVELOPMENTAL
1313 DISABILITY COORDINATING COUNCIL
1414 Sec. 531.491. DEFINITION. In this subchapter, "council"
1515 means the statewide intellectual and developmental disability
1616 coordinating council.
1717 Sec. 531.492. PURPOSE. The council is established to
1818 ensure this state develops a strategic approach for the provision
1919 of intellectual and developmental disability services in this
2020 state.
2121 Sec. 531.493. COMPOSITION OF COUNCIL. (a) The council is
2222 composed of the following members:
2323 (1) subject to Subsection (b), one or more
2424 representatives designated by each of the following entities:
2525 (A) the Department of State Health Services;
2626 (B) the Department of Family and Protective
2727 Services;
2828 (C) the Texas Workforce Commission;
2929 (D) the Texas Education Agency;
3030 (E) the Texas Center for Disability Studies at
3131 The University of Texas at Austin;
3232 (F) the Center on Disability and Development at
3333 Texas A&M University;
3434 (G) the Texas Department of Criminal Justice; and
3535 (H) the Commission on Jail Standards; and
3636 (2) the following members appointed by the executive
3737 commissioner:
3838 (A) a representative of a local intellectual and
3939 developmental disability authority as defined by Section 531.002,
4040 Health and Safety Code;
4141 (B) a representative of the Governor's Committee
4242 on People with Disabilities;
4343 (C) a representative of the Texas Council for
4444 Developmental Disabilities;
4545 (D) a representative of the Arc of Texas;
4646 (E) a representative of a managed care
4747 organization;
4848 (F) a provider of Medicaid long-term services and
4949 supports;
5050 (G) a person or family member of an individual
5151 with an intellectual or developmental disability;
5252 (H) a representative of the commission's office
5353 of the ombudsman;
5454 (I) representatives of the commission, with one
5555 representative appointed from each division of the commission with
5656 responsibility for:
5757 (i) Medicaid and the Children's Health
5858 Insurance Program services;
5959 (ii) intellectual and developmental
6060 disability behavioral health services;
6161 (iii) health and specialty care system
6262 employment;
6363 (iv) health, developmental, and
6464 independence services; and
6565 (v) access and eligibility services; and
6666 (J) any additional members as the executive
6767 commissioner determines appropriate who are recognized experts
6868 serving individuals with intellectual and developmental
6969 disabilities or who represent the interests of individuals with
7070 intellectual and developmental disabilities.
7171 (b) The executive commissioner shall determine the number
7272 of representatives that each entity may designate under Subsection
7373 (a)(1) to serve on the council.
7474 (c) The council may authorize another state agency or
7575 institution that provides specific intellectual and developmental
7676 disability services with the use of money appropriated by this
7777 state to designate a representative to the council.
7878 (d) A council member serves at the pleasure of the
7979 designating entity.
8080 Sec. 531.494. PRESIDING OFFICER. The executive
8181 commissioner shall designate a member of the council to serve as the
8282 presiding officer.
8383 Sec. 531.495. MEETINGS. The council shall meet at least
8484 once quarterly or more frequently at the call of the presiding
8585 officer.
8686 Sec. 531.496. DUTIES. The council:
8787 (1) shall develop and monitor the implementation of a
8888 five-year statewide intellectual and developmental disability
8989 strategic plan;
9090 (2) shall develop a biennial coordinated statewide
9191 intellectual and developmental disability expenditure proposal;
9292 (3) shall annually publish an updated inventory of
9393 state-funded intellectual and developmental disability programs
9494 and services that includes:
9595 (A) a description of the manner in which those
9696 programs and services further the purpose of the statewide
9797 intellectual and developmental disability strategic plan; and
9898 (B) an estimate of the number of individuals
9999 waiting for or interested in receiving those programs and services;
100100 and
101101 (4) may facilitate opportunities to increase
102102 collaboration for the effective expenditure of available federal
103103 and state funds for intellectual and developmental disability
104104 services in this state.
105105 SECTION 2. This Act takes effect immediately if it receives
106106 a vote of two-thirds of all the members elected to each house, as
107107 provided by Section 39, Article III, Texas Constitution. If this
108108 Act does not receive the vote necessary for immediate effect, this
109109 Act takes effect September 1, 2023.
