8 | 8 | | patients receiving emergency medical services. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Subchapter A, Chapter 773, Health and Safety |
---|
11 | 11 | | Code, is amended by adding Section 773.0125 to read as follows: |
---|
12 | 12 | | Sec. 773.0125. PERSONAL ASSISTIVE MOBILITY DEVICE |
---|
13 | 13 | | PROTECTIONS. (a) In this section: |
---|
14 | 14 | | (1) "Hospital" means a general hospital, a pediatric |
---|
15 | 15 | | and adolescent hospital, or a special hospital, as those terms are |
---|
16 | 16 | | defined by Section 241.003. |
---|
17 | 17 | | (2) "Personal assistive mobility device" means a |
---|
18 | 18 | | wheelchair or a motorized assistive mobility device, including a |
---|
19 | 19 | | motorized wheelchair. |
---|
20 | 20 | | (b) This section applies to the transport, custody, and |
---|
21 | 21 | | control of a personal assistive mobility device of a patient who is |
---|
22 | 22 | | receiving emergency medical services while the device is: |
---|
23 | 23 | | (1) in an emergency medical services vehicle; |
---|
24 | 24 | | (2) being transported or controlled by emergency |
---|
25 | 25 | | medical services personnel, including volunteers; |
---|
26 | 26 | | (3) being transported or controlled by an emergency |
---|
27 | 27 | | medical services provider; |
---|
28 | 28 | | (4) under the custody or control of a hospital; or |
---|
29 | 29 | | (5) under the custody or control of an individual who |
---|
30 | 30 | | is providing the emergency medical services for an emergency |
---|
31 | 31 | | medical services and trauma care system. |
---|
32 | 32 | | (c) The executive commissioner shall adopt rules to: |
---|
33 | 33 | | (1) ensure the safety and security of and the |
---|
34 | 34 | | protection of property rights in a patient's personal assistive |
---|
35 | 35 | | mobility device while the patient is receiving emergency medical |
---|
36 | 36 | | services as described by Subsection (b); and |
---|
37 | 37 | | (2) require each person or entity that provides the |
---|
38 | 38 | | emergency medical services to adopt procedures, in accordance with |
---|
39 | 39 | | commission rules, for the: |
---|
40 | 40 | | (A) safe and secure storage of the patient's |
---|
41 | 41 | | personal assistive mobility device for the duration of the service |
---|
42 | 42 | | provision; |
---|
43 | 43 | | (B) return to the patient of the patient's |
---|
44 | 44 | | personal assistive mobility device at the time the service |
---|
45 | 45 | | provision concludes; and |
---|
46 | 46 | | (C) safe and secure transfer of the patient's |
---|
47 | 47 | | personal assistive mobility device from one person providing |
---|
48 | 48 | | emergency medical services as described by Subsection (b) to |
---|
49 | 49 | | another person providing those services, including the transfer of |
---|
50 | 50 | | a personal assistive mobility device for a patient who is |
---|
51 | 51 | | transported by air. |
---|
52 | 52 | | SECTION 2. As soon as practicable after the effective date |
---|
53 | 53 | | of this Act, the executive commissioner of the Health and Human |
---|
54 | 54 | | Services Commission shall adopt the rules required by Section |
---|
55 | 55 | | 773.0125, Health and Safety Code, as added by this Act. |
---|
56 | 56 | | SECTION 3. This Act takes effect September 1, 2023. |
