66 AN ACT
77 relating to personal assistive mobility device protections for
88 patients receiving emergency medical services.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 773, Health and Safety
1111 Code, is amended by adding Section 773.0125 to read as follows:
1212 Sec. 773.0125. PERSONAL ASSISTIVE MOBILITY DEVICE
1313 PROTECTIONS. (a) In this section:
1414 (1) "Hospital" means a general hospital, a pediatric
1515 and adolescent hospital, or a special hospital, as those terms are
1616 defined by Section 241.003.
1717 (2) "Personal assistive mobility device" means a
1818 wheelchair or a motorized assistive mobility device, including a
1919 motorized wheelchair.
2020 (b) This section applies to the transport, custody, and
2121 control of a personal assistive mobility device of a patient who is
2222 receiving emergency medical services while the device is:
2323 (1) in an emergency medical services vehicle;
2424 (2) being transported or controlled by emergency
2525 medical services personnel, including volunteers;
2626 (3) being transported or controlled by an emergency
2727 medical services provider;
2828 (4) under the custody or control of a hospital; or
2929 (5) under the custody or control of an individual who
3030 is providing the emergency medical services for an emergency
3131 medical services and trauma care system.
3232 (c) The executive commissioner shall adopt rules to:
3333 (1) ensure the safety and security of and the
3434 protection of property rights in a patient's personal assistive
3535 mobility device while the patient is receiving emergency medical
3636 services as described by Subsection (b); and
3737 (2) require each person or entity that provides the
3838 emergency medical services to adopt procedures, in accordance with
3939 commission rules, for the:
4040 (A) safe and secure storage of the patient's
4141 personal assistive mobility device for the duration of the service
4242 provision;
4343 (B) return to the patient of the patient's
4444 personal assistive mobility device at the time the service
4545 provision concludes; and
4646 (C) safe and secure transfer of the patient's
4747 personal assistive mobility device from one person providing
4848 emergency medical services as described by Subsection (b) to
4949 another person providing those services, including the transfer of
5050 a personal assistive mobility device for a patient who is
5151 transported by air.
5252 SECTION 2. As soon as practicable after the effective date
5353 of this Act, the executive commissioner of the Health and Human
5454 Services Commission shall adopt the rules required by Section
5555 773.0125, Health and Safety Code, as added by this Act.
5656 SECTION 3. This Act takes effect September 1, 2023.
