| 7 | 7 | | relating to a rebate of the assessment on the gross receipts of |

| 8 | 8 | | electricity for certain providers of retail electric service. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 16, Utilities Code, is |
|---|
| 11 | 11 | | amended by adding Section 16.0015 to read as follows: |
|---|
| 12 | 12 | | Sec. 16.0015. REBATE OF ASSESSMENT FOR CERTAIN UTILITIES. |
|---|
| 13 | 13 | | (a) In this section, "child-care facility" and "day-care center" |
|---|
| 14 | 14 | | have the meanings assigned by Section 42.002, Human Resources Code. |
|---|
| 15 | 15 | | (b) An electric utility, retail electric provider, or |
|---|
| 16 | 16 | | electric cooperative that is subject to Section 16.001 and provides |
|---|
| 17 | 17 | | retail electric service to a child-care facility or day-care center |
|---|
| 18 | 18 | | at a rate that is reduced by 50 to 100 percent of the regular rate |
|---|
| 19 | 19 | | for that service is entitled to a rebate from the comptroller under |
|---|
| 20 | 20 | | this section. The electric utility, retail electric provider, or |
|---|
| 21 | 21 | | electric cooperative is entitled to an annual or quarterly, as |
|---|
| 22 | 22 | | applicable, rebate in an amount that is equal to the amount of the |
|---|
| 23 | 23 | | total retail charges, excluding taxes and other fees, that the |
|---|
| 24 | 24 | | utility, provider, or cooperative discounted to all child-care |
|---|
| 25 | 25 | | facilities and day-care centers receiving service from the utility, |
|---|
| 26 | 26 | | provider, or cooperative during the period for which the rebate is |
|---|
| 27 | 27 | | requested. The rebate may not exceed the total amount of |
|---|
| 28 | 28 | | assessments the electric utility, retail electric provider, or |
|---|
| 29 | 29 | | electric cooperative owes to the state under this chapter for the |
|---|
| 30 | 30 | | period for which the rebate is requested. |
|---|
| 31 | 31 | | (c) To receive a rebate under this section, an electric |
|---|
| 32 | 32 | | utility, retail electric provider, or electric cooperative shall |
|---|
| 33 | 33 | | submit a list to the comptroller, signed under penalty of perjury, |
|---|
| 34 | 34 | | of the child-care facilities and day-care centers to which the |
|---|
| 35 | 35 | | utility, provider, or cooperative provided retail electric service |
|---|
| 36 | 36 | | at no cost or a reduced rate for the period for which the rebate is |
|---|
| 37 | 37 | | requested. |
|---|
| 38 | 38 | | (d) The comptroller may adopt rules as necessary to |
|---|
| 39 | 39 | | implement this section. |
|---|
| 40 | 40 | | SECTION 2. The change in law made by this Act does not |
|---|
| 41 | 41 | | affect assessments due before the effective date of this Act, and |
|---|
| 42 | 42 | | the law in effect before the effective date of this Act is continued |
|---|
| 43 | 43 | | in effect for purposes of the liability for those assessments. |
|---|
| 44 | 44 | | SECTION 3. This Act takes effect September 1, 2023. |
