66 AN ACT
77 relating to a rebate of the assessment on the gross receipts of
88 electricity for certain providers of retail electric service.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 16, Utilities Code, is
1111 amended by adding Section 16.0015 to read as follows:
1212 Sec. 16.0015. REBATE OF ASSESSMENT FOR CERTAIN UTILITIES.
1313 (a) In this section, "child-care facility" and "day-care center"
1414 have the meanings assigned by Section 42.002, Human Resources Code.
1515 (b) An electric utility, retail electric provider, or
1616 electric cooperative that is subject to Section 16.001 and provides
1717 retail electric service to a child-care facility or day-care center
1818 at a rate that is reduced by 50 to 100 percent of the regular rate
1919 for that service is entitled to a rebate from the comptroller under
2020 this section. The electric utility, retail electric provider, or
2121 electric cooperative is entitled to an annual or quarterly, as
2222 applicable, rebate in an amount that is equal to the amount of the
2323 total retail charges, excluding taxes and other fees, that the
2424 utility, provider, or cooperative discounted to all child-care
2525 facilities and day-care centers receiving service from the utility,
2626 provider, or cooperative during the period for which the rebate is
2727 requested. The rebate may not exceed the total amount of
2828 assessments the electric utility, retail electric provider, or
2929 electric cooperative owes to the state under this chapter for the
3030 period for which the rebate is requested.
3131 (c) To receive a rebate under this section, an electric
3232 utility, retail electric provider, or electric cooperative shall
3333 submit a list to the comptroller, signed under penalty of perjury,
3434 of the child-care facilities and day-care centers to which the
3535 utility, provider, or cooperative provided retail electric service
3636 at no cost or a reduced rate for the period for which the rebate is
3737 requested.
3838 (d) The comptroller may adopt rules as necessary to
3939 implement this section.
4040 SECTION 2. The change in law made by this Act does not
4141 affect assessments due before the effective date of this Act, and
4242 the law in effect before the effective date of this Act is continued
4343 in effect for purposes of the liability for those assessments.
4444 SECTION 3. This Act takes effect September 1, 2023.
