| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter K, Chapter 17, Water Code, is amended |
|---|
| 12 | 12 | | by adding Section 17.9227 to read as follows: |
|---|
| 13 | 13 | | Sec. 17.9227. GENERATORS TO SUPPORT WATER SUPPLY AND SEWER |
|---|
| 14 | 14 | | SERVICE. (a) The legislature finds that it is in the public |
|---|
| 15 | 15 | | interest to use funds in the economically distressed areas account |
|---|
| 16 | 16 | | to provide financial assistance for the costs associated with |
|---|
| 17 | 17 | | backup power generators for facilities of public water supply and |
|---|
| 18 | 18 | | sanitary sewer systems. |
|---|
| 19 | 19 | | (b) A political subdivision may use financial assistance to |
|---|
| 20 | 20 | | pay for the installation, maintenance, operation, and fueling of a |
|---|
| 21 | 21 | | backup power generator for a facility of a public water supply and |
|---|
| 22 | 22 | | sanitary sewer system. |
|---|
| 23 | 23 | | (c) Assistance under this section shall only be provided to |
|---|
| 24 | 24 | | political subdivisions that demonstrate an inability to pay for the |
|---|
| 25 | 25 | | installation, maintenance, operation, and fueling of a backup power |
|---|
| 26 | 26 | | generator described by Subsection (b) in accordance with board |
|---|
| 27 | 27 | | rules. If the board determines that a political subdivision to |
|---|
| 28 | 28 | | which assistance has been provided is ineligible to receive the |
|---|
| 29 | 29 | | assistance, the board may seek reimbursement from the political |
|---|
| 30 | 30 | | subdivision. |
|---|
| 31 | 31 | | (d) The board shall adopt rules to implement this section. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect September 1, 2023. |
