66 AN ACT
77 relating to financial assistance by the Texas Water Development
88 Board for backup power generators in economically distressed areas
99 for public water supply and sanitary sewer systems.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter K, Chapter 17, Water Code, is amended
1212 by adding Section 17.9227 to read as follows:
1313 Sec. 17.9227. GENERATORS TO SUPPORT WATER SUPPLY AND SEWER
1414 SERVICE. (a) The legislature finds that it is in the public
1515 interest to use funds in the economically distressed areas account
1616 to provide financial assistance for the costs associated with
1717 backup power generators for facilities of public water supply and
1818 sanitary sewer systems.
1919 (b) A political subdivision may use financial assistance to
2020 pay for the installation, maintenance, operation, and fueling of a
2121 backup power generator for a facility of a public water supply and
2222 sanitary sewer system.
2323 (c) Assistance under this section shall only be provided to
2424 political subdivisions that demonstrate an inability to pay for the
2525 installation, maintenance, operation, and fueling of a backup power
2626 generator described by Subsection (b) in accordance with board
2727 rules. If the board determines that a political subdivision to
2828 which assistance has been provided is ineligible to receive the
2929 assistance, the board may seek reimbursement from the political
3030 subdivision.
3131 (d) The board shall adopt rules to implement this section.
3232 SECTION 2. This Act takes effect September 1, 2023.
