| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 2113.011, Government Code, is amended by |
|---|
| 9 | 9 | | adding Subsection (f) to read as follows: |
|---|
| 10 | 10 | | (f) This section does not prohibit the Texas State Guard |
|---|
| 11 | 11 | | from using appropriated money for the purpose of recruiting or |
|---|
| 12 | 12 | | retaining service members, employees, or other personnel. In this |
|---|
| 13 | 13 | | subsection, "service member" and "Texas State Guard" have the |
|---|
| 14 | 14 | | meanings assigned by Section 437.001. |
|---|
| 15 | 15 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 16 | 16 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 17 | 17 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 18 | 18 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 19 | 19 | | Act takes effect September 1, 2023. |
