55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to a study on leasing state property for private use.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. DEFINITIONS. In this Act:
1010 (1) "Board" means the Texas Higher Education
1111 Coordinating Board.
1212 (2) "Commission" means the Texas Facilities
1313 Commission.
1414 (3) "Space" means a room, conference room, hall,
1515 stage, dance studio, rehearsal space, or other area in a state
1616 building or on state property.
1717 SECTION 2. STUDY REGARDING LEASED SPACE OF STATE AGENCIES.
1818 (a) In collaboration with the Texas Commission on the Arts, the
1919 commission shall conduct a study to assess the feasibility of
2020 leasing to artists for the practice and performance of their arts
2121 available spaces in state agency buildings or on state agency
2222 property.
2323 (b) In conducting the study, the commission shall consider:
2424 (1) the types of spaces in state agency buildings or on
2525 state agency property that are appropriate for leasing;
2626 (2) the location of each building or property with a
2727 space identified as potentially available for lease;
2828 (3) the times each identified space would be available
2929 for lease;
3030 (4) the persons to whom each identified space may be
3131 leased;
3232 (5) any disadvantages to leasing each identified
3333 space, including sensitive surroundings or information that may be
3434 at risk during the lease;
3535 (6) the fair market value for leasing each identified
3636 space;
3737 (7) any tax implications for accepting a lease payment
3838 from a private business for private use of each identified space;
3939 (8) the use limitations that may need to be included in
4040 a lease agreement for each identified space;
4141 (9) security measures that hinder or enhance the
4242 availability or value of each identified space; and
4343 (10) any other issue that would negatively impact or
4444 prohibit leasing each identified space.
4545 (c) The study must identify:
4646 (1) the criteria used to determine the feasibility of
4747 leasing each space identified as available for lease;
4848 (2) the measures instituted to avoid viewpoint bias or
4949 other possible biases in the selection of a lease holder;
5050 (3) the authorized uses of lease income by state
5151 agencies to benefit each agency offering space for lease; and
5252 (4) the reasons a state agency would be authorized to
5353 decline to lease space at the agency.
5454 SECTION 3. STUDY REGARDING LEASED SPACE OF PUBLIC
5555 INSTITUTIONS OF HIGHER EDUCATION. (a) In collaboration with the
5656 Texas Commission on the Arts, the board shall conduct a study to
5757 assess the feasibility of leasing to artists for the practice and
5858 performance of their arts available spaces in buildings or property
5959 of public institutions of higher education in this state.
6060 (b) In conducting the study, the board shall consider:
6161 (1) the types of spaces in buildings or on property of
6262 public institutions of higher education that are appropriate for
6363 leasing;
6464 (2) the location of each building or property with a
6565 space identified as potentially available for lease;
6666 (3) the times each identified space would be available
6767 for lease;
6868 (4) the persons to whom each identified space may be
6969 leased;
7070 (5) any disadvantages to leasing each identified
7171 space, including sensitive surroundings or information that may be
7272 at risk during the lease;
7373 (6) the fair market value for leasing each identified
7474 space;
7575 (7) any tax implications for accepting a lease payment
7676 from a private business for private use of each identified space;
7777 (8) the use limitations that may need to be included in
7878 a lease agreement for each identified space;
7979 (9) security measures that hinder or enhance the
8080 availability or value of each identified space; and
8181 (10) any other issue that would negatively impact or
8282 prohibit leasing each identified space.
8383 (c) The study must identify:
8484 (1) the criteria used to determine the feasibility of
8585 leasing each space identified as available for lease;
8686 (2) the measures instituted to avoid viewpoint bias or
8787 other possible biases in the selection of a lease holder;
8888 (3) the authorized uses of lease income by public
8989 institutions of higher education to benefit each institution
9090 offering space for lease; and
9191 (4) the reasons a public institution of higher
9292 education would be authorized to decline to lease space at the
9393 institution.
9494 SECTION 4. REPORT TO LEGISLATURE. Not later than December
9595 2, 2024, the commission and board shall submit a report to each
9696 member of the legislature that includes the results of the studies
9797 conducted under Sections 2 and 3 of this Act and any recommendations
9898 of the commission and board related to the studies and statutory
9999 changes necessary to authorize leasing space to artists for the
100100 practice and performance of their arts at state agencies and public
101101 institutions of higher education.
102102 SECTION 5. EXPIRATION. This Act expires September 1, 2025.
103103 SECTION 6. This Act takes effect immediately if it receives
104104 a vote of two-thirds of all the members elected to each house, as
105105 provided by Section 39, Article III, Texas Constitution. If this
106106 Act does not receive the vote necessary for immediate effect, this
107107 Act takes effect September 1, 2023.
