1111 A BILL TO BE ENTITLED
1212 AN ACT
1313 relating to parental rights regarding a threat assessment of a
1414 student conducted by a public school's threat assessment and safe
1515 and supportive school team.
1616 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1717 SECTION 1. Section 37.115, Education Code, is amended by
1818 adding Subsections (f-1) and (f-2) to read as follows:
1919 (f-1) Before a team may conduct a threat assessment of a
2020 student, the team must notify the parent of or person standing in
2121 parental relation to the student regarding the assessment. In
2222 conducting the assessment, the team shall make a good faith effort
2323 to provide an opportunity for the parent or person to:
2424 (1) participate in the assessment, either in person or
2525 remotely; and
2626 (2) submit to the team information regarding the
2727 student.
2828 (f-2) After completing a threat assessment of a student, the
2929 team shall provide to the parent of or person standing in parental
3030 relation to the student the team's findings and conclusions
3131 regarding the student.
3232 SECTION 2. This Act applies beginning with the 2023-2024
3333 school year.
3434 SECTION 3. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2023.
