| 13 | 13 | | relating to parental rights regarding a threat assessment of a |

| 14 | 14 | | student conducted by a public school's threat assessment and safe |
|---|
| 15 | 15 | | and supportive school team. |

| 16 | 16 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 17 | 17 | | SECTION 1. Section 37.115, Education Code, is amended by |
|---|
| 18 | 18 | | adding Subsections (f-1) and (f-2) to read as follows: |
|---|
| 19 | 19 | | (f-1) Before a team may conduct a threat assessment of a |
|---|
| 20 | 20 | | student, the team must notify the parent of or person standing in |
|---|
| 21 | 21 | | parental relation to the student regarding the assessment. In |
|---|
| 22 | 22 | | conducting the assessment, the team shall make a good faith effort |
|---|
| 23 | 23 | | to provide an opportunity for the parent or person to: |
|---|
| 24 | 24 | | (1) participate in the assessment, either in person or |
|---|
| 25 | 25 | | remotely; and |
|---|
| 26 | 26 | | (2) submit to the team information regarding the |
|---|
| 27 | 27 | | student. |
|---|
| 28 | 28 | | (f-2) After completing a threat assessment of a student, the |
|---|
| 29 | 29 | | team shall provide to the parent of or person standing in parental |
|---|
| 30 | 30 | | relation to the student the team's findings and conclusions |
|---|
| 31 | 31 | | regarding the student. |
|---|
| 32 | 32 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 33 | 33 | | school year. |
|---|
| 34 | 34 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2023. |
