77 relating to the authority of a general-law municipality or county
88 to regulate residential child detention facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 250, Local Government Code, is amended
1111 by adding Section 250.014 to read as follows:
1212 Sec. 250.014. REGULATION OF CERTAIN RESIDENTIAL CHILD
1313 DETENTION FACILITIES. (a) In this section, "residential child
1414 detention facility" means a private facility other than a facility
1515 licensed by this state that operates under a contract with the
1616 United States Immigration and Customs Enforcement, the United
1717 States Department of Health and Human Services, or another federal
1818 agency to provide 24-hour custody or care to unaccompanied
1919 immigrant or refugee children.
2020 (b) This section applies only to a residential child
2121 detention facility.
2222 (c) A general-law municipality or a county in the
2323 unincorporated area of the county may:
2424 (1) designate an area in which a residential child
2525 detention facility may be located; and
2626 (2) take other measures necessary to protect the
2727 health and safety of the individuals residing in a residential
2828 child detention facility.
2929 SECTION 2. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2023.
