7 | 7 | | relating to the authority of a general-law municipality or county |

8 | 8 | | to regulate residential child detention facilities. |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Chapter 250, Local Government Code, is amended |
---|
11 | 11 | | by adding Section 250.014 to read as follows: |
---|
12 | 12 | | Sec. 250.014. REGULATION OF CERTAIN RESIDENTIAL CHILD |
---|
13 | 13 | | DETENTION FACILITIES. (a) In this section, "residential child |
---|
14 | 14 | | detention facility" means a private facility other than a facility |
---|
15 | 15 | | licensed by this state that operates under a contract with the |
---|
16 | 16 | | United States Immigration and Customs Enforcement, the United |
---|
17 | 17 | | States Department of Health and Human Services, or another federal |
---|
18 | 18 | | agency to provide 24-hour custody or care to unaccompanied |
---|
19 | 19 | | immigrant or refugee children. |
---|
20 | 20 | | (b) This section applies only to a residential child |
---|
21 | 21 | | detention facility. |
---|
22 | 22 | | (c) A general-law municipality or a county in the |
---|
23 | 23 | | unincorporated area of the county may: |
---|
24 | 24 | | (1) designate an area in which a residential child |
---|
25 | 25 | | detention facility may be located; and |
---|
26 | 26 | | (2) take other measures necessary to protect the |
---|
27 | 27 | | health and safety of the individuals residing in a residential |
---|
28 | 28 | | child detention facility. |
---|
29 | 29 | | SECTION 2. This Act takes effect immediately if it receives |
---|
30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
---|
31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
---|
33 | 33 | | Act takes effect September 1, 2023. |
