5	5	relating to the confidentiality of certain personal information of
6	6	an applicant for or a person protected by a protective order.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 82.011, Family Code, is amended to read
9	9	as follows:
10	10	Sec. 82.011. CONFIDENTIALITY OF CERTAIN INFORMATION. On
11	11	request by an applicant, the court may protect the applicant's
12	12	mailing address and county of residence by rendering an order:
13	13	(1) requiring the applicant to:
14	14	(A) disclose the applicant's mailing address and
15	15	county of residence to the court;
16	16	(B) designate a person to receive on behalf of
17	17	the applicant any notice or documents filed with the court related
18	18	to the application; and
19	19	(C) disclose the designated person's mailing
20	20	address to the court;
21	21	(2) requiring the court clerk to:
22	22	(A) strike the applicant's mailing address and
23	23	county of residence from the public records of the court, if
24	24	applicable; and
25	25	(B) maintain a confidential record of the
26	26	applicant's mailing address and county of residence for use only by
27	27	the court; and
28	28	(3) prohibiting the release of the information to the
29	29	respondent.
30	30	SECTION 2. Section 85.007(a), Family Code, is amended to
31	31	read as follows:
32	32	(a) On request by a person protected by an order or member of
33	33	the family or household of a person protected by an order, the court
34	34	may exclude from a protective order:
35	35	(1) the address, county of residence, and telephone
36	36	number of[:
37	37	[(1)] a person protected by the order[, in which case
38	38	the order shall state the county in which the person resides]; or
39	39	(2) the address and telephone number of:
40	40	(A) the place of employment or business of a
41	41	person protected by the order; or
42	42	(B) [(3)] the child-care facility or school a
43	43	child protected by the order attends or in which the child resides.
44	44	SECTION 3. (a) Section 82.011, Family Code, as amended by
45	45	this Act, applies only to an application for a protective order that
46	46	is filed on or after the effective date of this Act. An application
47	47	for a protective order filed before the effective date of this Act
48	48	is governed by the law in effect on the date the application is
49	49	filed, and the former law is continued in effect for that purpose.
50	50	(b) Section 85.007, Family Code, as amended by this Act,
51	51	applies to a protective order regardless of whether the protective
52	52	order was rendered before, on, or after the effective date of this
53	53	Act.
54	54	SECTION 4. This Act takes effect September 1, 2023.
