| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 232.0085(a), Local Government Code, is |
|---|
| 9 | 9 | | amended to read as follows: |
|---|
| 10 | 10 | | (a) This section applies only to real property that |
|---|
| 11 | 11 | | [located]: |
|---|
| 12 | 12 | | (1) [outside municipalities and the extraterritorial |
|---|
| 13 | 13 | | jurisdiction of municipalities, as determined under Chapter 42; and |
|---|
| 14 | 14 | | [(2)] is located in the unincorporated area of an |
|---|
| 15 | 15 | | affected county, as defined by Section 16.341, Water Code, that: |
|---|
| 16 | 16 | | (A) has adopted the model rules developed under |
|---|
| 17 | 17 | | Section 16.343, Water Code;[,] and |
|---|
| 18 | 18 | | (B) is located along an international border; and |
|---|
| 19 | 19 | | (2) if the area is located in the extraterritorial |
|---|
| 20 | 20 | | jurisdiction of a municipality, is not subject to a written |
|---|
| 21 | 21 | | agreement under Section 242.001 that authorizes the municipality to |
|---|
| 22 | 22 | | regulate subdivision plats and approve related permits in the |
|---|
| 23 | 23 | | extraterritorial jurisdiction. |

| 24 | 24 | | SECTION 2. This Act takes effect September 1, 2023. |
