55 relating to requirements for and charges for service from public
66 drinking water supply systems.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 341.0315, Health and Safety Code, is
99 amended by amending Subsection (c) and adding Subsection (c-1) to
1010 read as follows:
1111 (c) Each public drinking water supply system shall provide
1212 an adequate and safe drinking water supply. The supply must:
1313 (1) meet the requirements of Section 341.031 and
1414 commission rules; and
1515 (2) provide a quantity of water or capacity of water
1616 sufficient to serve the number of connections served by the public
1717 drinking water supply system.
1818 (c-1) Notwithstanding any other law, the commission by rule
1919 shall establish connection equivalency values for each meter size
2020 used to serve a recreational vehicle park, as defined by Section
2121 13.087, Water Code, for use in determining the number of
2222 connections served by a public drinking water supply system that
2323 provides service through meters. When determining the number of
2424 connections, the commission may only consider service for which a
2525 meter has been installed that conforms with industry standards.
2626 The rules must:
2727 (1) establish that eight recreational vehicle or cabin
2828 sites at a recreational vehicle park, whether occupied or not, are
2929 equivalent to one residential metered connection; and
3030 (2) provide a variance from a connection equivalency
3131 value established under this subsection for a public drinking water
3232 supply system if actual system usage is more than 10 percent below
3333 the equivalency value.
3434 SECTION 2. Subchapter E, Chapter 13, Water Code, is amended
3535 by adding Section 13.152 to read as follows:
3636 Sec. 13.152. BILLING FOR RECREATIONAL VEHICLE PARKS. (a)
3737 In this section, "recreational vehicle park" has the meaning
3838 assigned by Section 13.087.
3939 (b) A retail public utility, other than a municipally owned
4040 utility described by Section 13.087, providing water or sewer
4141 service to a recreational vehicle park:
4242 (1) shall ensure that billing for the service is based
4343 on actual water usage recorded by the retail public utility; and
4444 (2) may not impose a surcharge based on the number of
4545 recreational vehicle or cabin sites in the recreational vehicle
4646 park.
4747 SECTION 3. This Act takes effect September 1, 2023.
