7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
8 | 8 | | SECTION 1. Section 341.0315, Health and Safety Code, is |
---|
9 | 9 | | amended by amending Subsection (c) and adding Subsection (c-1) to |
---|
10 | 10 | | read as follows: |
---|
11 | 11 | | (c) Each public drinking water supply system shall provide |
---|
12 | 12 | | an adequate and safe drinking water supply. The supply must: |
---|
13 | 13 | | (1) meet the requirements of Section 341.031 and |
---|
14 | 14 | | commission rules; and |
---|
15 | 15 | | (2) provide a quantity of water or capacity of water |
---|
16 | 16 | | sufficient to serve the number of connections served by the public |
---|
17 | 17 | | drinking water supply system. |
---|
18 | 18 | | (c-1) Notwithstanding any other law, the commission by rule |
---|
19 | 19 | | shall establish connection equivalency values for each meter size |
---|
20 | 20 | | used to serve a recreational vehicle park, as defined by Section |
---|
21 | 21 | | 13.087, Water Code, for use in determining the number of |
---|
22 | 22 | | connections served by a public drinking water supply system that |
---|
23 | 23 | | provides service through meters. When determining the number of |
---|
24 | 24 | | connections, the commission may only consider service for which a |
---|
25 | 25 | | meter has been installed that conforms with industry standards. |
---|
26 | 26 | | The rules must: |
---|
27 | 27 | | (1) establish that eight recreational vehicle or cabin |
---|
28 | 28 | | sites at a recreational vehicle park, whether occupied or not, are |
---|
29 | 29 | | equivalent to one residential metered connection; and |
---|
30 | 30 | | (2) provide a variance from a connection equivalency |
---|
31 | 31 | | value established under this subsection for a public drinking water |
---|
32 | 32 | | supply system if actual system usage is more than 10 percent below |
---|
33 | 33 | | the equivalency value. |
---|
34 | 34 | | SECTION 2. Subchapter E, Chapter 13, Water Code, is amended |
---|
35 | 35 | | by adding Section 13.152 to read as follows: |
---|
36 | 36 | | Sec. 13.152. BILLING FOR RECREATIONAL VEHICLE PARKS. (a) |
---|
37 | 37 | | In this section, "recreational vehicle park" has the meaning |
---|
38 | 38 | | assigned by Section 13.087. |
---|
39 | 39 | | (b) A retail public utility, other than a municipally owned |
---|
40 | 40 | | utility described by Section 13.087, providing water or sewer |
---|
41 | 41 | | service to a recreational vehicle park: |
---|
42 | 42 | | (1) shall ensure that billing for the service is based |
---|
43 | 43 | | on actual water usage recorded by the retail public utility; and |
---|
44 | 44 | | (2) may not impose a surcharge based on the number of |
---|
45 | 45 | | recreational vehicle or cabin sites in the recreational vehicle |
---|
46 | 46 | | park. |
---|
47 | 47 | | SECTION 3. This Act takes effect September 1, 2023. |
