55 relating to operating agreements between holders of a distiller's
66 and rectifier's permit and certain alcoholic beverage permit
77 holders.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 14, Alcoholic Beverage Code, is amended
1010 by adding Section 14.10 to read as follows:
1111 Sec. 14.10. OPERATING AGREEMENTS BETWEEN PERMIT HOLDERS.
1212 (a) The holder of a distiller's and rectifier's permit may enter
1313 into an agreement with another holder of a distiller's and
1414 rectifier's permit that allows the distiller's and rectifier's
1515 permit holder to engage in the following activities on the
1616 permitted premises of the other distiller's and rectifier's permit
1717 holder:
1818 (1) manufacture distilled spirits;
1919 (2) rectify, purify, and refine distilled spirits and
2020 wines;
2121 (3) mix wines, distilled spirits, or other liquors;
2222 (4) bottle, label, and package the permit holder's
2323 finished products;
2424 (5) sell the finished products in this state to
2525 holders of wholesaler's permits and to authorized wholesalers and
2626 manufacturers outside the state;
2727 (6) sell, through an affiliate who is the holder of a
2828 nonresident seller's permit, the finished products in this state to
2929 holders of wholesaler's permits and to authorized wholesalers and
3030 manufacturers outside the state;
3131 (7) purchase distilled spirits, to be used only for
3232 manufacturing or rectification purposes, from holders of
3333 nonresident seller's permits or distiller's and rectifier's
3434 permits; and
3535 (8) sell bulk alcohol produced by the permit holder
3636 for purposes described by Section 38.01.
3737 (b) The agreement is subject to approval by the commission
3838 and must describe with specificity the nature, duration, and extent
3939 of the activities authorized by the agreement.
4040 (c) The holder of a distiller's and rectifier's permit may
4141 enter into an agreement authorized by Section 37.011 with the
4242 holder of a nonresident seller's permit.
4343 (d) The holder of a distiller's and rectifier's permit on
4444 whose premises another distiller's and rectifier's permit holder
4545 contracts under this section to manufacture, bottle, package, or
4646 label alcoholic beverages may not:
4747 (1) consider or treat the alcoholic beverages
4848 manufactured, bottled, packaged, or labeled under the agreement as
4949 being owned by the permit holder; or
5050 (2) sell those alcoholic beverages on the permit
5151 holder's premises.
5252 (e) The commission shall adopt rules regulating the shared
5353 use of the permitted premises under this section to ensure
5454 administrative accountability of each permit holder and a strict
5555 separation between the businesses and operations of the permit
5656 holders.
5757 SECTION 2. Chapter 37, Alcoholic Beverage Code, is amended
5858 by adding Section 37.011 to read as follows:
5959 Sec. 37.011. OPERATING AGREEMENT WITH IN-STATE DISTILLERY.
6060 (a) The holder of a nonresident seller's permit who owns a
6161 distillery outside of the state or whose affiliate owns a
6262 distillery outside of the state and holds a distiller's and
6363 rectifier's permit may enter into an agreement with the holder of a
6464 distiller's and rectifier's permit that allows the nonresident
6565 seller to engage in the following activities on the distiller's and
6666 rectifier's permitted premises:
6767 (1) manufacture distilled spirits;
6868 (2) rectify, purify, and refine distilled spirits and
6969 wines;
7070 (3) mix wines, distilled spirits, or other liquors;
7171 (4) bottle, label, and package the nonresident
7272 seller's finished products; and
7373 (5) sell the finished products in this state to
7474 holders of distiller's and rectifier's permits and holders of
7575 wholesaler's permits and to authorized wholesalers and
7676 manufacturers outside the state.
7777 (b) The agreement is subject to approval by the commission
7878 and must describe with specificity the nature, duration, and extent
7979 of the activities authorized by the agreement.
8080 (c) The holder of a distiller's and rectifier's permit on
8181 whose premises the holder of a nonresident seller's permit
8282 contracts under this section to manufacture, bottle, package, or
8383 label alcoholic beverages may not:
8484 (1) consider or treat the alcoholic beverages
8585 manufactured, bottled, packaged, or labeled under the agreement as
8686 being owned by the distiller's and rectifier's permit holder; or
8787 (2) sell those alcoholic beverages on the distiller's
8888 and rectifier's permit holder's premises.
8989 (d) The commission shall adopt rules regulating the shared
9090 use of the permitted premises under this section to ensure
9191 administrative accountability of each permit holder and a strict
9292 separation between the businesses and operations of the permit
9393 holders.
9494 SECTION 3. This Act takes effect September 1, 2023.
