66 AN ACT
77 relating to a public outreach and education campaign for
88 mixed-status families regarding eligibility for Medicaid and the
99 child health plan program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1212 amended by adding Section 531.021483 to read as follows:
1313 Sec. 531.021483. PUBLIC OUTREACH CAMPAIGN FOR MIXED-STATUS
1414 FAMILIES ON MEDICAID AND CHILD HEALTH PLAN PROGRAM ELIGIBILITY.
1515 (a) In this section, "mixed-status family" means a family in which
1616 one or more members is not a citizen or national of the United
1717 States and one or more members is a citizen or national of the
1818 United States.
1919 (b) The commission shall conduct a public outreach and
2020 education campaign designed to educate and inform mixed-status
2121 families about eligibility requirements under Medicaid and the
2222 child health plan program. The campaign must:
2323 (1) clearly explain the programs' eligibility
2424 requirements relating to residency and citizenship status,
2525 including the programs' eligibility requirements for citizens,
2626 qualified aliens, and lawful permanent residents;
2727 (2) inform individuals that a child's receipt of
2828 benefits under a program will not affect the immigration status of
2929 the child's parent;
3030 (3) be tailored to the population targeted by the
3131 campaign, including by providing information in English and Spanish
3232 or another language spoken by the majority of the targeted
3333 population; and
3434 (4) be disseminated through methods designed to reach
3535 the targeted population, including by:
3636 (A) distributing information and providing
3737 presentations at health fairs; and
3838 (B) working with relevant organizations or
3939 groups, including community clinics.
4040 (c) To support the campaign conducted under this section,
4141 the commission shall develop informational material about Medicaid
4242 and child health plan program eligibility criteria relating to
4343 residency and citizenship status that is:
4444 (1) up-to-date;
4545 (2) clear and easy to understand; and
4646 (3) made available in English and Spanish or another
4747 language spoken by the majority of a targeted population.
4848 SECTION 2. This Act takes effect September 1, 2023.
