55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the vaccination against bacterial meningitis of public
88 school students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 38.001, Education Code, is amended by
1111 adding Subsection (a-1) to read as follows:
1212 (a-1) Each student shall be fully immunized against
1313 bacterial meningitis, except as provided by Subsection (c). To
1414 satisfy the requirement of this subsection, a student must show
1515 proof of a quadrivalent meningococcal conjugate vaccine and a
1616 booster dose of that vaccine in accordance with the recommended
1717 immunization schedule adopted by the Department of State Health
1818 Services, as well as any additional vaccine recommended for the
1919 prevention of bacterial meningitis by the federal Centers for
2020 Disease Control and Prevention. The executive commissioner of the
2121 Health and Human Services Commission shall adopt rules for the
2222 implementation of this subsection.
2323 SECTION 2. Not later than June 1, 2024, the executive
2424 commissioner of the Health and Human Services Commission shall
2525 adopt the rules necessary to implement Section 38.001(a-1),
2626 Education Code, as added by this Act.
2727 SECTION 3. Section 38.001(a-1), Education Code, as added by
2828 this Act, applies beginning with the 2024-2025 school year.
2929 SECTION 4. This Act takes effect September 1, 2023.
