55 AN ACT
66 relating to the designation of fentanyl poisoning for purposes of
77 the death certificate and to the criminal penalties for certain
88 controlled substance offenses; increasing a criminal penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 193.005, Health and Safety Code, is
1111 amended by adding Subsection (e-1) to read as follows:
1212 (e-1) The medical certification on a death certificate must
1313 include the term "Fentanyl Poisoning" if:
1414 (1) a toxicology examination reveals a controlled
1515 substance listed in Penalty Group 1-B present in the body of the
1616 decedent in an amount or concentration that is considered to be
1717 lethal by generally accepted scientific standards; and
1818 (2) the results of an autopsy performed on the
1919 decedent are consistent with an opioid overdose as the cause of
2020 death.
2121 SECTION 2. Section 481.102, Health and Safety Code, is
2222 amended to read as follows:
2323 Sec. 481.102. PENALTY GROUP 1. Penalty Group 1 consists
2424 of:
2525 (1) the following opiates, including their isomers,
2626 esters, ethers, salts, and salts of isomers, esters, and ethers,
2727 unless specifically excepted, if the existence of these isomers,

236236 less than 10 years, and a fine not to exceed $100,000, if the amount
237237 of the controlled substance to which the offense applies is, by
238238 aggregate weight, including adulterants or dilutants, 200 grams or
239239 more but less than 400 grams.
240240 (f) An offense under Subsection (a) is a felony of the first
241241 degree punishable by imprisonment in the Texas Department of
242242 Criminal Justice for life or for a term of not more than 99 years or
243243 less than 15 years, and a fine not to exceed $250,000, if the amount
244244 of the controlled substance to which the offense applies is, by
245245 aggregate weight, including adulterants or dilutants, 400 grams or
246246 more.
247247 SECTION 5. Section 481.1121(b), Health and Safety Code, is
248248 amended to read as follows:
249249 (b) An offense under this section is:
250250 (1) a state jail felony if the number of abuse units of
251251 the controlled substance is fewer than 20;
252252 (2) a felony of the second degree if the number of
253253 abuse units of the controlled substance is 20 or more but fewer than
254254 80;
255255 (3) a felony of the first degree if the number of abuse
256256 units of the controlled substance is 80 or more but fewer than
257257 4,000; and
258258 (4) a felony of the first degree punishable by
259259 imprisonment in the Texas Department of Criminal Justice for life
260260 or for a term of not more than 99 years or less than 15 years and a
261261 fine not to exceed $250,000, if the number of abuse units of the
262262 controlled substance is 4,000 or more.
263263 SECTION 6. Sections 481.1123(b), (d), (e), and (f), Health
264264 and Safety Code, are amended to read as follows:
265265 (b) An offense under Subsection (a) is a [state jail] felony
266266 of the third degree if the amount of the controlled substance to
267267 which the offense applies is, by aggregate weight, including
268268 adulterants or dilutants, less than one gram.
269269 (d) An offense under Subsection (a) is a felony of the first
270270 degree punishable by imprisonment in the Texas Department of
271271 Criminal Justice for life or for a term of not more than 99 years or
272272 less than 10 years, and a fine not to exceed $20,000, if the amount
273273 of the controlled substance to which the offense applies is, by
274274 aggregate weight, including adulterants or dilutants, four grams or
275275 more but less than 200 grams.
276276 (e) An offense under Subsection (a) is a felony of the first
277277 degree punishable by imprisonment in the Texas Department of
278278 Criminal Justice for life or for a term of not more than 99 years or
279279 less than 15 years, and a fine not to exceed $200,000, if the amount
280280 of the controlled substance to which the offense applies is, by
281281 aggregate weight, including adulterants or dilutants, 200 grams or
282282 more but less than 400 grams.
283283 (f) An offense under Subsection (a) is a felony of the first
284284 degree punishable by imprisonment in the Texas Department of
285285 Criminal Justice for life or for a term of not more than 99 years or
286286 less than 20 years, and a fine not to exceed $500,000, if the amount
287287 of the controlled substance to which the offense applies is, by
288288 aggregate weight, including adulterants or dilutants, 400 grams or
289289 more.
290290 SECTION 7. Section 481.113(e), Health and Safety Code, is
291291 amended to read as follows:
292292 (e) An offense under Subsection (a) is a felony of the first
293293 degree punishable by imprisonment in the Texas Department of
294294 Criminal Justice for life or for a term of not more than 99 years or
295295 less than 10 years, and a fine not to exceed $100,000, if the amount
296296 of the controlled substance to which the offense applies is, by
297297 aggregate weight, including adulterants or dilutants, 400 grams or
298298 more.
299299 SECTION 8. Section 481.114(e), Health and Safety Code, is
300300 amended to read as follows:
301301 (e) An offense under Subsection (a) is a felony of the first

313313 less than 10 years, and a fine not to exceed $100,000, if the amount
314314 of the controlled substance possessed is, by aggregate weight,
315315 including adulterants or dilutants, 400 grams or more.
316316 SECTION 10. Section 481.1151(b), Health and Safety Code, is
317317 amended to read as follows:
318318 (b) An offense under this section is:
319319 (1) a state jail felony if the number of abuse units of
320320 the controlled substance is fewer than 20;
321321 (2) a felony of the third degree if the number of abuse
322322 units of the controlled substance is 20 or more but fewer than 80;
323323 (3) a felony of the second degree if the number of
324324 abuse units of the controlled substance is 80 or more but fewer than
325325 4,000;
326326 (4) a felony of the first degree if the number of abuse
327327 units of the controlled substance is 4,000 or more but fewer than
328328 8,000; and
329329 (5) a felony of the first degree punishable by
330330 imprisonment in the Texas Department of Criminal Justice for life
331331 or for a term of not more than 99 years or less than 15 years and a
332332 fine not to exceed $250,000, if the number of abuse units of the
333333 controlled substance is 8,000 or more.
334334 SECTION 11. Section 481.116(e), Health and Safety Code, is
335335 amended to read as follows:
336336 (e) An offense under Subsection (a) is a felony of the first
337337 degree punishable by imprisonment in the Texas Department of
338338 Criminal Justice for life or for a term of not more than 99 years or
339339 less than five years, and a fine not to exceed $50,000, if the
340340 amount of the controlled substance possessed is, by aggregate
341341 weight, including adulterants or dilutants, 400 grams or more.
342342 SECTION 12. Section 481.1161(b), Health and Safety Code, is
343343 amended to read as follows:
344344 (b) An offense under this section is:
345345 (1) a Class B misdemeanor if the amount of the
346346 controlled substance possessed is, by aggregate weight, including
347347 adulterants or dilutants, two ounces or less;
348348 (2) a Class A misdemeanor if the amount of the
349349 controlled substance possessed is, by aggregate weight, including
350350 adulterants or dilutants, four ounces or less but more than two
351351 ounces;
352352 (3) a state jail felony if the amount of the controlled
353353 substance possessed is, by aggregate weight, including adulterants
354354 or dilutants, five pounds or less but more than four ounces;
355355 (4) a felony of the third degree if the amount of the
356356 controlled substance possessed is, by aggregate weight, including
357357 adulterants or dilutants, 50 pounds or less but more than 5 pounds;
358358 (5) a felony of the second degree if the amount of the
359359 controlled substance possessed is, by aggregate weight, including
360360 adulterants or dilutants, 2,000 pounds or less but more than 50
361361 pounds; and
362362 (6) a felony of the first degree punishable by
363363 imprisonment in the Texas Department of Criminal Justice for life
364364 or for a term of not more than 99 years or less than 5 years, and a
365365 fine not to exceed $50,000, if the amount of the controlled
366366 substance possessed is, by aggregate weight, including adulterants
367367 or dilutants, more than 2,000 pounds.
368368 SECTION 13. Section 481.117(e), Health and Safety Code, is
369369 amended to read as follows:
370370 (e) An offense under Subsection (a) is a felony of the first
371371 degree punishable by imprisonment in the Texas Department of
372372 Criminal Justice for life or for a term of not more than 99 years or
373373 less than five years, and a fine not to exceed $50,000, if the
374374 amount of the controlled substance possessed is, by aggregate
375375 weight, including adulterants or dilutants, 400 grams or more.
376376 SECTION 14. Section 481.118(e), Health and Safety Code, is
377377 amended to read as follows:
378378 (e) An offense under Subsection (a) is a felony of the first
379379 degree punishable by imprisonment in the Texas Department of
380380 Criminal Justice for life or for a term of not more than 99 years or
381381 less than five years, and a fine not to exceed $50,000, if the
382382 amount of the controlled substance possessed is, by aggregate
383383 weight, including adulterants or dilutants, 400 grams or more.
384384 SECTION 15. Section 481.120(b), Health and Safety Code, is
385385 amended to read as follows:
386386 (b) An offense under Subsection (a) is:
387387 (1) a Class B misdemeanor if the amount of marihuana
388388 delivered is one-fourth ounce or less and the person committing the
389389 offense does not receive remuneration for the marihuana;
390390 (2) a Class A misdemeanor if the amount of marihuana
391391 delivered is one-fourth ounce or less and the person committing the
392392 offense receives remuneration for the marihuana;
393393 (3) a state jail felony if the amount of marihuana
394394 delivered is five pounds or less but more than one-fourth ounce;
395395 (4) a felony of the second degree if the amount of
396396 marihuana delivered is 50 pounds or less but more than five pounds;
397397 (5) a felony of the first degree if the amount of
398398 marihuana delivered is 2,000 pounds or less but more than 50 pounds;
399399 and
400400 (6) a felony of the first degree punishable by
401401 imprisonment in the Texas Department of Criminal Justice for life
402402 or for a term of not more than 99 years or less than 10 years, and a
403403 fine not to exceed $100,000, if the amount of marihuana delivered is
404404 more than 2,000 pounds.
405405 SECTION 16. Section 481.121(b), Health and Safety Code, is
406406 amended to read as follows:
407407 (b) An offense under Subsection (a) is:
408408 (1) a Class B misdemeanor if the amount of marihuana
409409 possessed is two ounces or less;
410410 (2) a Class A misdemeanor if the amount of marihuana
411411 possessed is four ounces or less but more than two ounces;
412412 (3) a state jail felony if the amount of marihuana
413413 possessed is five pounds or less but more than four ounces;
414414 (4) a felony of the third degree if the amount of
415415 marihuana possessed is 50 pounds or less but more than 5 pounds;
416416 (5) a felony of the second degree if the amount of
417417 marihuana possessed is 2,000 pounds or less but more than 50 pounds;
418418 and
419419 (6) a felony of the first degree punishable by
420420 imprisonment in the Texas Department of Criminal Justice for life
421421 or for a term of not more than 99 years or less than 5 years, and a
422422 fine not to exceed $50,000, if the amount of marihuana possessed is
423423 more than 2,000 pounds.
424424 SECTION 17. Section 481.126(a), Health and Safety Code, is
425425 amended to read as follows:
426426 (a) A person commits an offense if the person:
427427 (1) barters property or expends funds the person knows
428428 are derived from the commission of a first degree felony [an]
429429 offense under this chapter punishable by imprisonment in the Texas
430430 Department of Criminal Justice for life;
431431 (2) barters property or expends funds the person knows
432432 are derived from the commission of an offense under Section
433433 481.121(a) that is punishable under Section 481.121(b)(5);
434434 (3) barters property or finances or invests funds the
435435 person knows or believes are intended to further the commission of
436436 an offense for which the punishment is described by Subdivision
437437 (1); or
438438 (4) barters property or finances or invests funds the
439439 person knows or believes are intended to further the commission of
440440 an offense under Section 481.121(a) that is punishable under
441441 Section 481.121(b)(5).
442442 SECTION 18. Section 481.134(c), Health and Safety Code, as
443443 amended by Chapters 584 (S.B. 768) and 807 (H.B. 1540), Acts of the
444444 87th Legislature, Regular Session, 2021, is reenacted and amended
445445 to read as follows:
446446 (c) The minimum term of confinement or imprisonment for an
447447 offense otherwise punishable under Section 481.112(c), (d), (e), or
448448 (f), 481.1121(b)(2), (3), or (4), 481.1123(b), (c) [481.1123(c)],
449449 (d), (e), or (f), 481.113(c), (d), or (e), 481.114(c), (d), or (e),
450450 481.115(c)-(f), 481.1151(b)(2), (3), (4), or (5), 481.116(c), (d),
451451 or (e), 481.1161(b)(4), (5), or (6), 481.117(c), (d), or (e),
452452 481.118(c), (d), or (e), 481.120(b)(4), (5), or (6), or
453453 481.121(b)(4), (5), or (6) is increased by five years and the
454454 maximum fine for the offense is doubled if it is shown on the trial
455455 of the offense that the offense was committed:
456456 (1) in, on, or within 1,000 feet of the premises of a
457457 school, the premises of a public or private youth center, or a
458458 playground;
459459 (2) on a school bus; or
460460 (3) by any unauthorized person 18 years of age or
461461 older, in, on, or within 1,000 feet of premises owned, rented, or
462462 leased by a general residential operation operating as a
463463 residential treatment center.
464464 SECTION 19. Section 481.141, Health and Safety Code, is
465465 amended by adding Subsection (d) to read as follows:
466466 (d) Punishment may not be increased under this section if
467467 the defendant is also prosecuted under Section 19.02(b)(4), Penal
468468 Code, for conduct occurring during the same criminal episode.
469469 SECTION 20. Section 19.02, Penal Code, is amended by
470470 amending Subsection (b) and adding Subsection (e) to read as
471471 follows:
472472 (b) A person commits an offense if the person [he]:
473473 (1) intentionally or knowingly causes the death of an
474474 individual;
475475 (2) intends to cause serious bodily injury and commits
476476 an act clearly dangerous to human life that causes the death of an
477477 individual; [or]
478478 (3) commits or attempts to commit a felony, other than
479479 manslaughter, and in the course of and in furtherance of the
480480 commission or attempt, or in immediate flight from the commission
481481 or attempt, the person [he] commits or attempts to commit an act
482482 clearly dangerous to human life that causes the death of an
483483 individual; or
484484 (4) knowingly manufactures or delivers a controlled
485485 substance listed in Penalty Group 1-B under Section 481.1022,
486486 Health and Safety Code, in violation of Section 481.1123, Health
487487 and Safety Code, and an individual dies as a result of injecting,
488488 ingesting, inhaling, or introducing into the individual's body any
489489 amount of the controlled substance manufactured or delivered by the
490490 actor, regardless of whether the controlled substance was used by
491491 itself or with another substance, including a drug, adulterant, or
492492 dilutant.
493493 (e) It is a defense to prosecution under Subsection (b)(4)
494494 that the actor's conduct in manufacturing or delivering the
495495 controlled substance was authorized under Chapter 481, Health and
496496 Safety Code, or other state or federal law.
497497 SECTION 21. Section 71.02(a), Penal Code, is amended to
498498 read as follows:
499499 (a) A person commits an offense if, with the intent to
500500 establish, maintain, or participate in a combination or in the
501501 profits of a combination or as a member of a criminal street gang,
502502 the person commits or conspires to commit one or more of the
503503 following:
504504 (1) murder, capital murder, arson, aggravated
505505 robbery, robbery, burglary, theft, aggravated kidnapping,
506506 kidnapping, aggravated assault, aggravated sexual assault, sexual
507507 assault, continuous sexual abuse of young child or disabled
508508 individual, solicitation of a minor, forgery, deadly conduct,
509509 assault punishable as a Class A misdemeanor, burglary of a motor
510510 vehicle, or unauthorized use of a motor vehicle;
511511 (2) any gambling offense punishable as a Class A
512512 misdemeanor;
513513 (3) promotion of prostitution, aggravated promotion
514514 of prostitution, or compelling prostitution;
515515 (4) unlawful manufacture, transportation, repair, or
516516 sale of firearms or prohibited weapons;
517517 (5) unlawful manufacture, delivery, dispensation, or
518518 distribution of a controlled substance or dangerous drug, or
519519 unlawful possession of a controlled substance or dangerous drug
520520 through forgery, fraud, misrepresentation, or deception;
521521 (5-a) causing the unlawful delivery, dispensation, or
522522 distribution of a controlled substance or dangerous drug in
523523 violation of Subtitle B, Title 3, Occupations Code;
524524 (5-b) unlawful possession with intent to deliver a
525525 controlled substance listed in Penalty Group 1-B under Section
526526 481.1022, Health and Safety Code;
527527 (6) any unlawful wholesale promotion or possession of
528528 any obscene material or obscene device with the intent to wholesale
529529 promote the same;
530530 (7) any offense under Subchapter B, Chapter 43,
531531 depicting or involving conduct by or directed toward a child
532532 younger than 18 years of age;
533533 (8) any felony offense under Chapter 32;
534534 (9) any offense under Chapter 36;
535535 (10) any offense under Chapter 34, 35, or 35A;
536536 (11) any offense under Section 37.11(a);
537537 (12) any offense under Chapter 20A;
538538 (13) any offense under Section 37.10;
539539 (14) any offense under Section 38.06, 38.07, 38.09, or
540540 38.11;
541541 (15) any offense under Section 42.10;
542542 (16) any offense under Section 46.06(a)(1) or 46.14;
543543 (17) any offense under Section 20.05 or 20.06;
544544 (18) any offense under Section 16.02; or
545545 (19) any offense classified as a felony under the Tax
546546 Code.
547547 SECTION 22. The change in law made by this Act to Section
548548 193.005, Health and Safety Code, applies only to a death that occurs
549549 on or after the effective date of this Act, or a death that occurs
550550 before that date but is discovered on or after the effective date of
551551 this Act.
552552 SECTION 23. The changes in law made by this Act to Chapter
553553 481, Health and Safety Code, and Sections 19.02 and 71.02, Penal
554554 Code, apply only to an offense committed on or after the effective
555555 date of this Act. An offense committed before the effective date of
556556 this Act is governed by the law in effect on the date the offense was
557557 committed, and the former law is continued in effect for that
558558 purpose. For purposes of this section, an offense was committed
559559 before the effective date of this Act if any element of the offense
560560 occurred before that date.
561561 SECTION 24. To the extent of any conflict, this Act prevails
562562 over another Act of the 88th Legislature, Regular Session, 2023,
563563 relating to nonsubstantive additions to and corrections in enacted
564564 codes.
565565 SECTION 25. This Act takes effect September 1, 2023.
