| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 61.059, Education Code, is amended by |
|---|
| 9 | 9 | | adding Subsection (n-1) to read as follows: |
|---|
| 10 | 10 | | (n-1) In the formula applicable to Lamar State |
|---|
| 11 | 11 | | College--Orange for funding instruction and administration, the |
|---|
| 12 | 12 | | board shall include any contact hours taught through distance |
|---|
| 13 | 13 | | education to students enrolled at that college who reside in |
|---|
| 14 | 14 | | another state and: |
|---|
| 15 | 15 | | (1) as permitted by Section 54.231(a), pay tuition at |
|---|
| 16 | 16 | | the rate charged to residents of this state; and |
|---|
| 17 | 17 | | (2) reside in a county or parish in the other state |
|---|
| 18 | 18 | | that is contiguous to the county in which the college is located. |
|---|
| 19 | 19 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 20 | 20 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 21 | 21 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 22 | 22 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 23 | 23 | | Act takes effect September 1, 2023. |
