| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 37, Water Code, is amended by adding |
|---|
| 11 | 11 | | Section 37.0045 to read as follows: |
|---|
| 12 | 12 | | Sec. 37.0045. QUALIFICATIONS FOR CERTAIN LICENSES. (a) |
|---|
| 13 | 13 | | This section applies only to a Class D license for wastewater |
|---|
| 14 | 14 | | operators or public water system operators. |
|---|
| 15 | 15 | | (b) In adopting educational attainment standards associated |
|---|
| 16 | 16 | | with the issuance of a license, the commission by rule shall |
|---|
| 17 | 17 | | establish a provisional certification program by which a person who |
|---|
| 18 | 18 | | does not possess a high school diploma or its equivalent may act as |
|---|
| 19 | 19 | | a provisional operator if the person: |
|---|
| 20 | 20 | | (1) has completed all commission-required training |
|---|
| 21 | 21 | | associated with the license; |
|---|
| 22 | 22 | | (2) has passed any commission-required examinations |
|---|
| 23 | 23 | | associated with the license; and |
|---|
| 24 | 24 | | (3) acts under the direct supervision of a license |
|---|
| 25 | 25 | | holder. |
|---|
| 26 | 26 | | SECTION 2. This Act takes effect September 1, 2023. |
