| 8 | 8 | | teaching materials. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 26, Education Code, is amended by adding |
|---|
| 11 | 11 | | Section 26.0061 to read as follows: |
|---|
| 12 | 12 | | Sec. 26.0061. REQUIRED DISCLOSURE REGARDING CURRICULA AND |
|---|
| 13 | 13 | | TEACHING MATERIALS. (a) In this section, "teaching material" |
|---|
| 14 | 14 | | includes: |
|---|
| 15 | 15 | | (1) instructional material, as that term is defined by |
|---|
| 16 | 16 | | Section 31.002; |
|---|
| 17 | 17 | | (2) supplemental material; |
|---|
| 18 | 18 | | (3) teaching aids; and |
|---|
| 19 | 19 | | (4) any other material a student is given the option to |
|---|
| 20 | 20 | | select for the student's instruction. |
|---|
| 21 | 21 | | (b) Subject to Subsection (d), not later than the seventh |
|---|
| 22 | 22 | | day before the date curricula or teaching materials will be |
|---|
| 23 | 23 | | implemented, assigned, distributed, or otherwise presented to |
|---|
| 24 | 24 | | students, each school district and open-enrollment charter school |
|---|
| 25 | 25 | | shall make those items available to the public on the district's or |
|---|
| 26 | 26 | | school's Internet website, disaggregated by subject area and grade |
|---|
| 27 | 27 | | level. |
|---|
| 28 | 28 | | (c) Information posted to a school district's or |
|---|
| 29 | 29 | | open-enrollment charter school's Internet website under Subsection |
|---|
| 30 | 30 | | (b) must be maintained on the website for not less than 10 years. |
|---|
| 31 | 31 | | (d) A school district or open-enrollment charter school |
|---|
| 32 | 32 | | must make curricula and teaching materials described by Subsection |
|---|
| 33 | 33 | | (b) available in a manner that complies with copyright law and |
|---|
| 34 | 34 | | otherwise prevents the items from being copied. Items that cannot |
|---|
| 35 | 35 | | be made available on the district's or school's Internet website |
|---|
| 36 | 36 | | must be made available for review by parents in accordance with |
|---|
| 37 | 37 | | Section 26.006. |
|---|
| 38 | 38 | | SECTION 2. This Act applies beginning with the 2024-2025 |
|---|
| 39 | 39 | | school year. |
|---|
| 40 | 40 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 41 | 41 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 42 | 42 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 43 | 43 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 44 | 44 | | Act takes effect September 1, 2023. |
