66 AN ACT
77 relating to requiring the disclosure of public school curricula and
88 teaching materials.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 26, Education Code, is amended by adding
1111 Section 26.0061 to read as follows:
1212 Sec. 26.0061. REQUIRED DISCLOSURE REGARDING CURRICULA AND
1313 TEACHING MATERIALS. (a) In this section, "teaching material"
1414 includes:
1515 (1) instructional material, as that term is defined by
1616 Section 31.002;
1717 (2) supplemental material;
1818 (3) teaching aids; and
1919 (4) any other material a student is given the option to
2020 select for the student's instruction.
2121 (b) Subject to Subsection (d), not later than the seventh
2222 day before the date curricula or teaching materials will be
2323 implemented, assigned, distributed, or otherwise presented to
2424 students, each school district and open-enrollment charter school
2525 shall make those items available to the public on the district's or
2626 school's Internet website, disaggregated by subject area and grade
2727 level.
2828 (c) Information posted to a school district's or
2929 open-enrollment charter school's Internet website under Subsection
3030 (b) must be maintained on the website for not less than 10 years.
3131 (d) A school district or open-enrollment charter school
3232 must make curricula and teaching materials described by Subsection
3333 (b) available in a manner that complies with copyright law and
3434 otherwise prevents the items from being copied. Items that cannot
3535 be made available on the district's or school's Internet website
3636 must be made available for review by parents in accordance with
3737 Section 26.006.
3838 SECTION 2. This Act applies beginning with the 2024-2025
3939 school year.
4040 SECTION 3. This Act takes effect immediately if it receives
4141 a vote of two-thirds of all the members elected to each house, as
4242 provided by Section 39, Article III, Texas Constitution. If this
4343 Act does not receive the vote necessary for immediate effect, this
4444 Act takes effect September 1, 2023.
