55 AN ACT
66 relating to the reporting and investigating certain causes of child
77 abuse or neglect involving a pregnant woman's use of a controlled
88 substance.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 261.101, Family Code, is amended by
1111 adding Subsection (b-2) to read as follows:
1212 (b-2) A professional providing prenatal, mental health, or
1313 other medical care to a woman who voluntarily discloses to the
1414 professional that the woman illegally used a controlled substance,
1515 as defined by Chapter 481, Health and Safety Code, during pregnancy
1616 is not required to make a report under this section if:
1717 (1) the woman provides proof that:
1818 (A) she is currently enrolled in or has recently
1919 completed a substance abuse treatment program; or
2020 (B) she made reasonable efforts to enroll in a
2121 substance abuse treatment program within five days after the date
2222 she made a disclosure described by this subsection; or
2323 (2) the professional determines:
2424 (A) there is no immediate risk of harm to the
2525 child from the exposure to the controlled substance; and
2626 (B) the woman does not otherwise pose an
2727 immediate risk of harm to the child.
2828 SECTION 2. Section 261.301, Family Code, is amended by
2929 amending Subsection (a) and adding Subsection (a-1) to read as
3030 follows:
3131 (a) Except as provided by Subsection (a-1), with [With]
3232 assistance from the appropriate state or local law enforcement
3333 agency as provided by this section, the department shall make a
3434 prompt and thorough investigation of a report of child abuse or
3535 neglect allegedly committed by a person responsible for a child's
3636 care, custody, or welfare. The investigation shall be conducted
3737 without regard to any pending suit affecting the parent-child
3838 relationship.
3939 (a-1) The department may not investigate a report of child
4040 abuse or neglect allegedly committed by a woman based on the woman's
4141 illegal use of a controlled substance, as defined by Chapter 481,
4242 Health and Safety Code, during pregnancy if the woman enrolls in and
4343 successfully completes a substance abuse treatment program under
4444 the supervision of the referring or treating professional.
4545 SECTION 3. This Act takes effect September 1, 2023.
