| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter I, Chapter 242, Health and Safety |
|---|
| 10 | 10 | | Code, as added by Section 1.01, Chapter 1280 (S.B. 84), Acts of the |
|---|
| 11 | 11 | | 75th Legislature, Regular Session, 1997, is amended by adding |
|---|
| 12 | 12 | | Section 242.3061 to read as follows: |
|---|
| 13 | 13 | | Sec. 242.3061. APPLICABILITY OF OTHER LAW. Chapter 53, |
|---|
| 14 | 14 | | Occupations Code, does not apply to the issuance or renewal of a |
|---|
| 15 | 15 | | license under this subchapter. |
|---|
| 16 | 16 | | SECTION 2. Subchapter I, Chapter 242, Health and Safety |
|---|
| 17 | 17 | | Code, as added by Section 2.01, Chapter 1280 (S.B. 84), Acts of the |
|---|
| 18 | 18 | | 75th Legislature, Regular Session, 1997, is amended by adding |
|---|
| 19 | 19 | | Section 242.3115 to read as follows: |
|---|
| 20 | 20 | | Sec. 242.3115. APPLICABILITY OF OTHER LAW. Chapter 53, |
|---|
| 21 | 21 | | Occupations Code, does not apply to the issuance or renewal of a |
|---|
| 22 | 22 | | license under this subchapter. |

| 23 | 23 | | SECTION 3. Subchapter N, Chapter 242, Health and Safety |
|---|
| 24 | 24 | | Code, is amended by adding Section 242.6111 to read as follows: |
|---|
| 25 | 25 | | Sec. 242.6111. APPLICABILITY OF OTHER LAW. Chapter 53, |
|---|
| 26 | 26 | | Occupations Code, does not apply to the issuance or renewal of a |
|---|
| 27 | 27 | | permit to administer medication under this subchapter. |
|---|
| 28 | 28 | | SECTION 4. Section 250.0035, Health and Safety Code, is |
|---|
| 29 | 29 | | amended by adding Subsection (c-1) to read as follows: |
|---|
| 30 | 30 | | (c-1) Chapter 53, Occupations Code, does not apply to the |
|---|
| 31 | 31 | | issuance or renewal of a nurse aide's certificate of registration |
|---|
| 32 | 32 | | or an applicant's inclusion in the nurse aide registry under this |
|---|
| 33 | 33 | | section. |
|---|
| 34 | 34 | | SECTION 5. The changes in law made by this Act to Chapters |
|---|
| 35 | 35 | | 242 and 250, Health and Safety Code, apply only to a license, |
|---|
| 36 | 36 | | permit, or certificate of registration issued or renewed on or |
|---|
| 37 | 37 | | after the effective date of this Act. A license, permit, or |
|---|
| 38 | 38 | | certificate of registration issued or renewed before the effective |
|---|
| 39 | 39 | | date of this Act is governed by the law in effect when the license, |
|---|
| 40 | 40 | | permit, or certificate was issued or renewed, and the former law is |
|---|
| 41 | 41 | | continued in effect for that purpose. |
|---|
| 42 | 42 | | SECTION 6. This Act takes effect September 1, 2023. |
