7 | 7 | | relating to the inspection periods for certain motor vehicles; |

8 | 8 | | increasing certain fees. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Section 382.202(d), Health and Safety Code, is |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (d) On adoption of a resolution by the commission and after |
---|
13 | 13 | | proper notice, the Department of Public Safety of the State of Texas |
---|
14 | 14 | | shall implement a system that requires, [as a condition of |
---|
15 | 15 | | obtaining a passing vehicle inspection report issued under |
---|
16 | 16 | | Subchapter C, Chapter 548, Transportation Code,] in a county that |
---|
17 | 17 | | is included in a vehicle emissions inspection and maintenance |
---|
18 | 18 | | program under Subchapter F, Chapter 548, Transportation Code [of |
---|
19 | 19 | | that chapter], that a motor vehicle registered in this state [the |
---|
20 | 20 | | vehicle], unless the vehicle is not covered by the system, be |
---|
21 | 21 | | annually or biennially inspected under the vehicle emissions |
---|
22 | 22 | | inspection and maintenance program as required by the state's air |
---|
23 | 23 | | quality state implementation plan. The Department of Public Safety |
---|
24 | 24 | | shall implement such a system when it is required by any provision |
---|
25 | 25 | | of federal or state law, including any provision of the state's air |
---|
26 | 26 | | quality state implementation plan. |
---|
27 | 27 | | SECTION 2. Section 548.101, Transportation Code, is amended |
---|
28 | 28 | | to read as follows: |
---|
29 | 29 | | Sec. 548.101. GENERAL FIVE-YEAR [ONE-YEAR] INSPECTION |
---|
30 | 30 | | PERIOD. Except as provided by Section 548.102, the department |
---|
31 | 31 | | shall require an [annual] inspection every five years. The |
---|
32 | 32 | | department shall set the periods of inspection and may make rules |
---|
33 | 33 | | with respect to those periods. [The rules must provide that: |
---|
34 | 34 | | [(1) a vehicle owner may obtain an inspection not |
---|
35 | 35 | | earlier than 90 days before the date of expiration of the vehicle's |
---|
36 | 36 | | registration; and |
---|
37 | 37 | | [(2) a used motor vehicle sold by a dealer, as defined |
---|
38 | 38 | | by Section 503.001, must be inspected in the 180 days preceding the |
---|
39 | 39 | | date the dealer sells the vehicle.] |
---|
40 | 40 | | SECTION 3. The heading to Section 548.102, Transportation |
---|
41 | 41 | | Code, is amended to read as follows: |
---|
42 | 42 | | Sec. 548.102. FIVE-YEAR [TWO-YEAR] INITIAL INSPECTION |
---|
43 | 43 | | PERIOD FOR PASSENGER CAR OR LIGHT TRUCK. |
---|
44 | 44 | | SECTION 4. Section 548.102(a), Transportation Code, is |
---|
45 | 45 | | amended to read as follows: |
---|
46 | 46 | | (a) The initial inspection period is five [two] years for a |
---|
47 | 47 | | passenger car or light truck that: |
---|
48 | 48 | | (1) is sold in this state or purchased by a commercial |
---|
49 | 49 | | fleet buyer described by Section 501.0234(b)(4) for use in this |
---|
50 | 50 | | state; |
---|
51 | 51 | | (2) has not been previously registered in this or |
---|
52 | 52 | | another state; and |
---|
53 | 53 | | (3) on the date of sale is of the current or preceding |
---|
54 | 54 | | model year. |
---|
55 | 55 | | SECTION 5. Subchapter C, Chapter 548, Transportation Code, |
---|
56 | 56 | | is amended by adding Section 548.106 to read as follows: |
---|
57 | 57 | | Sec. 548.106. TIMING OF INSPECTION FOR REGISTRATION-BASED |
---|
58 | 58 | | ENFORCEMENT. The department shall require a vehicle required to be |
---|
59 | 59 | | inspected under this chapter to pass the required inspection: |
---|
60 | 60 | | (1) for initial registration, not earlier than 90 days |
---|
61 | 61 | | before the date of registration; |
---|
62 | 62 | | (2) for a renewal of registration, not earlier than 90 |
---|
63 | 63 | | days before the date of expiration of the vehicle's registration; |
---|
64 | 64 | | (3) if the vehicle is a used motor vehicle sold by a |
---|
65 | 65 | | dealer, as defined by Section 503.001, in the 180 days preceding the |
---|
66 | 66 | | date the dealer sells the vehicle; or |
---|
67 | 67 | | (4) if the vehicle is subject to the federal motor |
---|
68 | 68 | | carrier safety regulations, in a period that complies with those |
---|
69 | 69 | | regulations. |
---|
70 | 70 | | SECTION 6. Section 548.254, Transportation Code, is amended |
---|
71 | 71 | | to read as follows: |
---|
72 | 72 | | Sec. 548.254. VALIDITY OF VEHICLE INSPECTION REPORT. The |
---|
73 | 73 | | department, and the conservation commission if necessary, by rule |
---|
74 | 74 | | shall establish the length of time a [A] vehicle inspection report |
---|
75 | 75 | | required by this chapter is valid [invalid after the end of the 12th |
---|
76 | 76 | | month following the month in which the report is issued]. |
---|
77 | 77 | | SECTION 7. Sections 548.501(a) and (b), Transportation |
---|
78 | 78 | | Code, are amended to read as follows: |
---|
79 | 79 | | (a) Except as provided by Sections 548.503 and 548.504, the |
---|
80 | 80 | | fee for inspection of a [motor] vehicle other than a moped is $26.50 |
---|
81 | 81 | | [$12.50]. The fee for inspection of a moped is $19.75 [$5.75]. |
---|
82 | 82 | | (b) Out of each fee for an inspection, $19.50 [$5.50] shall |
---|
83 | 83 | | be remitted to the state under Section 548.509. |
---|
84 | 84 | | SECTION 8. Section 548.502, Transportation Code, is amended |
---|
85 | 85 | | to read as follows: |
---|
86 | 86 | | Sec. 548.502. INSPECTION BY POLITICAL SUBDIVISION OR STATE |
---|
87 | 87 | | AGENCY. A political subdivision or state agency for which the |
---|
88 | 88 | | department certifies an inspection station under Section 548.004: |
---|
89 | 89 | | (1) shall pay to the state $27.50 [$5.50] for each |
---|
90 | 90 | | inspection under Section 548.509; and |
---|
91 | 91 | | (2) may not be required to pay the remainder of the |
---|
92 | 92 | | inspection fee. |
---|
93 | 93 | | SECTION 9. Section 548.503, Transportation Code, is amended |
---|
94 | 94 | | to read as follows: |
---|
95 | 95 | | Sec. 548.503. INITIAL FIVE-YEAR [TWO-YEAR] INSPECTION OF |
---|
96 | 96 | | PASSENGER CAR OR LIGHT TRUCK. (a) The fee for inspection of a |
---|
97 | 97 | | passenger car or light truck under Section 548.102 shall be set by |
---|
98 | 98 | | the department by rule on or before September 1 of each year. A fee |
---|
99 | 99 | | set by the department under this subsection must be based on the |
---|
100 | 100 | | costs of providing inspections and administering the program, but |
---|
101 | 101 | | may not be less than $32.25 [$21.75]. |
---|
102 | 102 | | (b) Out of each fee for an inspection under this section, |
---|
103 | 103 | | $25.25 [$14.75] shall be remitted to the state under Section |
---|
104 | 104 | | 548.509. |
---|
105 | 105 | | SECTION 10. Section 548.505, Transportation Code, is |
---|
106 | 106 | | amended to read as follows: |
---|
107 | 107 | | Sec. 548.505. EMISSIONS-RELATED INSPECTION FEE. (a) The |
---|
108 | 108 | | department by rule may impose an emissions-related inspection fee |
---|
109 | 109 | | for a vehicle inspected under Section 548.301(a) [in addition to |
---|
110 | 110 | | the fee provided by Section 548.501, 548.502, 548.503, or 548.504]. |
---|
111 | 111 | | A fee imposed under this subsection must be based on the costs of: |
---|
112 | 112 | | (1) providing inspections; and |
---|
113 | 113 | | (2) administering the program. |
---|
114 | 114 | | (b) The department may provide a maximum fee for an |
---|
115 | 115 | | inspection under this section [subchapter]. The department may not |
---|
116 | 116 | | set a minimum fee for an inspection under this section |
---|
117 | 117 | | [subchapter]. |
---|
118 | 118 | | SECTION 11. Section 548.508, Transportation Code, is |
---|
119 | 119 | | amended to read as follows: |
---|
120 | 120 | | Sec. 548.508. DISPOSITION OF FEES. Except as provided by |
---|
121 | 121 | | Sections 382.0622 and 382.202, Health and Safety Code, and Sections |
---|
122 | 122 | | [Section] 548.5055 and 548.510 of this code, each fee remitted to |
---|
123 | 123 | | the comptroller under this subchapter shall be deposited to the |
---|
124 | 124 | | credit of the Texas mobility fund. |
---|
125 | 125 | | SECTION 12. Section 548.509, Transportation Code, is |
---|
126 | 126 | | amended to read as follows: |
---|
127 | 127 | | Sec. 548.509. COLLECTION OF FEE DURING REGISTRATION. (a) |
---|
128 | 128 | | The Texas Department of Motor Vehicles or a county |
---|
129 | 129 | | assessor-collector that registers a motor vehicle that is subject |
---|
130 | 130 | | to an inspection fee under this chapter or Section 382.202, Health |
---|
131 | 131 | | and Safety Code, shall collect at the time of registration of the |
---|
132 | 132 | | motor vehicle the portion of the inspection fee that is required to |
---|
133 | 133 | | be remitted to the state. |
---|
134 | 134 | | (b) The Texas Department of Motor Vehicles or the county |
---|
135 | 135 | | assessor-collector shall remit the fee to the comptroller. |
---|
136 | 136 | | SECTION 13. This Act takes effect September 1, 2023. |
