| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 2a(a), Article 55.02, Code of Criminal |
|---|
| 11 | 11 | | Procedure, is amended to read as follows: |

| 12 | 12 | | (a) A person who is entitled to expunction of information |
|---|
| 13 | 13 | | contained in records and files under Article 55.01(d) may file an |
|---|
| 14 | 14 | | application for expunction with the attorney representing the state |
|---|
| 15 | 15 | | in the prosecution of felonies in the county in which: |
|---|
| 16 | 16 | | (1) the person resides; or |
|---|
| 17 | 17 | | (2) the offense was alleged to have occurred. |

| 18 | 18 | | SECTION 2. This Act applies to an expunction of information |
|---|
| 19 | 19 | | contained in arrest records and files relating to any criminal |
|---|
| 20 | 20 | | offense occurring before, on, or after the effective date of this |
|---|
| 21 | 21 | | Act. |
|---|
| 22 | 22 | | SECTION 3. This Act takes effect September 1, 2023. |
