55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to civil liability of a business in connection with
88 prohibiting concealed handguns on the business premises.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 95A, Civil Practice and Remedies Code,
1111 is amended by adding Section 95A.0002 to read as follows:
1212 Sec. 95A.0002. LIABILITY OF BUSINESS IN CONNECTION WITH
1313 PROHIBITING HANDGUNS. (a) In this section, "license holder" means
1414 a person licensed to carry a handgun under Subchapter H, Chapter
1515 411, Government Code.
1616 (b) A person with control over the premises of a business
1717 who prohibits entry on the premises by a license holder with a
1818 concealed handgun by posting a sign on the premises as described by
1919 Section 30.06, Penal Code, is liable for damages arising from a
2020 criminal act occurring on the premises.
2121 SECTION 2. The change in law made by this Act applies only
2222 to a cause of action that accrues on or after the effective date of
2323 this Act.
2424 SECTION 3. This Act takes effect September 1, 2023.
