| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 401.011, Labor Code, is amended by |
|---|
| 11 | 11 | | amending Subdivision (35-a) and adding Subdivision (35-b) to read |
|---|
| 12 | 12 | | as follows: |
|---|
| 13 | 13 | | (35-a) "Post-traumatic stress disorder" means a |
|---|
| 14 | 14 | | disorder that meets the diagnostic criteria for post-traumatic |
|---|
| 15 | 15 | | stress disorder specified by the American Psychiatric Association |
|---|
| 16 | 16 | | in the Diagnostic and Statistical Manual of Mental Disorders, 5th |
|---|
| 17 | 17 | | edition, or a later edition adopted by the commissioner. |
|---|
| 18 | 18 | | (35-b) "Prosthetic device" means an artificial device |
|---|
| 19 | 19 | | designed to replace, wholly or partly, an arm or leg. |
|---|
| 20 | 20 | | SECTION 2. Section 504.019(a)(2), Labor Code, is amended to |
|---|
| 21 | 21 | | read as follows: |
|---|
| 22 | 22 | | (2) "Post-traumatic stress disorder" has the meaning |
|---|
| 23 | 23 | | assigned by Section 401.011 [means a disorder that meets the |
|---|
| 24 | 24 | | diagnostic criteria for post-traumatic stress disorder specified |
|---|
| 25 | 25 | | by the American Psychiatric Association in the Diagnostic and |
|---|
| 26 | 26 | | Statistical Manual of Mental Disorders, fifth edition, or a later |
|---|
| 27 | 27 | | edition adopted by the commissioner of workers' compensation]. |
|---|
| 28 | 28 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 29 | 29 | | to a claim for workers' compensation benefits based on a |
|---|
| 30 | 30 | | compensable injury that occurs on or after the effective date of |
|---|
| 31 | 31 | | this Act. A claim based on a compensable injury that occurs before |
|---|
| 32 | 32 | | that date is governed by the law as it existed on the date the |
|---|
| 33 | 33 | | compensable injury occurred, and the former law is continued in |
|---|
| 34 | 34 | | effect for that purpose. |

| 35 | 35 | | SECTION 4. This Act takes effect September 1, 2023. |
