| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 437.309, Government Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | Sec. 437.309. TEXAS STATE GUARD RETIRED STATUS [HONORARY |
|---|
| 12 | 12 | | RESERVE]. (a) The governor, [or] adjutant general, or commander of |
|---|
| 13 | 13 | | the Texas State Guard, under the governor's authority and |
|---|
| 14 | 14 | | direction, shall place on retired status [may transfer to the Texas |
|---|
| 15 | 15 | | State Guard Honorary Reserve] an officer or enlisted service member |
|---|
| 16 | 16 | | of the Texas State Guard who, on separation from the Texas State |
|---|
| 17 | 17 | | Guard: |
|---|
| 18 | 18 | | (1) is physically disabled as a result of service[; |
|---|
| 19 | 19 | | [(2) is at least 60 years of age]; or |
|---|
| 20 | 20 | | (2) [(3)] has served the federal or state military |
|---|
| 21 | 21 | | satisfactorily for at least 20 years of combined service, with at |
|---|
| 22 | 22 | | least five years of service in the Texas State Guard. |
|---|
| 23 | 23 | | (b) The governor may advance the service member one grade or |
|---|
| 24 | 24 | | rank at the time of placement on retired status [the transfer into |
|---|
| 25 | 25 | | the honorary reserve]. For a service member who is not a general |
|---|
| 26 | 26 | | officer, the adjutant general may advance the service member one |
|---|
| 27 | 27 | | grade or rank at the time of placement on retired status [the |
|---|
| 28 | 28 | | transfer into the honorary reserve]. |
|---|
| 29 | 29 | | (c) The commander of the Texas State Guard shall issue an |
|---|
| 30 | 30 | | identification card to an officer or service member who is placed on |
|---|
| 31 | 31 | | retired status. |
|---|
| 32 | 32 | | SECTION 2. Section 437.308(a), Government Code, is amended |
|---|
| 33 | 33 | | to read as follows: |
|---|
| 34 | 34 | | (a) The commander of the Texas State Guard shall maintain |
|---|
| 35 | 35 | | and preserve the individual and unit records of the Texas State |
|---|
| 36 | 36 | | Guard and the officers or service members placed on retired status |
|---|
| 37 | 37 | | [the Texas State Guard Honorary Reserve]. |

| 38 | 38 | | SECTION 3. This Act takes effect September 1, 2023. |
