9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 6.104, Water Code, is amended to read as |
---|
11 | 11 | | follows: |
---|
12 | 12 | | Sec. 6.104. MEMORANDA OF UNDERSTANDING. The board may |
---|
13 | 13 | | enter into a memorandum of understanding with any other state |
---|
14 | 14 | | agency [and shall adopt by rule any memorandum of understanding |
---|
15 | 15 | | between the board and any other state agency]. |
---|
16 | 16 | | SECTION 2. The change in law made by this Act to Section |
---|
17 | 17 | | 6.104, Water Code, applies only to a memorandum of understanding |
---|
18 | 18 | | that is entered into on or after the effective date of this Act. A |
---|
19 | 19 | | memorandum of understanding that is entered into before that date |
---|
20 | 20 | | is governed by the law in effect on the date the memorandum of |
---|
21 | 21 | | understanding was entered into, and the former law is continued in |
---|
22 | 22 | | effect for that purpose. |
---|
23 | 23 | | SECTION 3. This Act takes effect September 1, 2023. |
