77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subtitle D, Title 2, Education Code, is amended
99 by adding Chapter 23 to read as follows:
1010 CHAPTER 23. SCHOOL CHAPLAINS
1111 Sec. 23.001. SCHOOL CHAPLAINS. (a) A school district or
1212 open-enrollment charter school may employ or accept as a volunteer
1313 a chaplain to provide support, services, and programs for students
1414 as assigned by the board of trustees of the district or the
1515 governing body of the school. A chaplain employed or volunteering
1616 under this chapter is not required to be certified by the State
1717 Board for Educator Certification.
1818 (b) A school district or open-enrollment charter school
1919 that employs or accepts as a volunteer a chaplain under this chapter
2020 shall ensure that the chaplain complies with the applicable
2121 requirements under Subchapter C, Chapter 22, before the chaplain
2222 begins employment or volunteering at the district or school.
2323 (c) A school district or open-enrollment charter school may
2424 not employ or accept as a volunteer a chaplain who has been
2525 convicted of or placed on deferred adjudication community
2626 supervision for an offense for which a defendant is required to
2727 register as a sex offender under Chapter 62, Code of Criminal
2828 Procedure.
2929 SECTION 2. Section 48.115(b), Education Code, is amended to
3030 read as follows:
3131 (b) Funds allocated under this section must be used to
3232 improve school safety and security, including costs associated
3333 with:
3434 (1) securing school facilities, including:
3535 (A) improvements to school infrastructure;
3636 (B) the use or installation of physical barriers;
3737 and
3838 (C) the purchase and maintenance of:
3939 (i) security cameras or other security
4040 equipment; and
4141 (ii) technology, including communications
4242 systems or devices, that facilitates communication and information
4343 sharing between students, school personnel, and first responders in
4444 an emergency;
4545 (2) providing security for the district, including:
4646 (A) employing school district peace officers,
4747 private security officers, and school marshals; and
4848 (B) collaborating with local law enforcement
4949 agencies, such as entering into a memorandum of understanding for
5050 the assignment of school resource officers to schools in the
5151 district;
5252 (3) school safety and security training and planning,
5353 including:
5454 (A) active shooter and emergency response
5555 training;
5656 (B) prevention and treatment programs relating
5757 to addressing adverse childhood experiences; and
5858 (C) the prevention, identification, and
5959 management of emergencies and threats, using evidence-based,
6060 effective prevention practices and including:
6161 (i) providing licensed counselors, social
6262 workers, chaplains, and individuals trained in restorative
6363 discipline and restorative justice practices;
6464 (ii) providing mental health personnel and
6565 support, including chaplains;
6666 (iii) providing behavioral health
6767 services, including services provided by chaplains;
6868 (iv) establishing threat reporting
6969 systems; and
7070 (v) developing and implementing programs
7171 focused on restorative justice practices, culturally relevant
7272 instruction, and providing mental health support, including
7373 support provided by chaplains; and
7474 (4) providing programs related to suicide prevention,
7575 intervention, and postvention, including programs provided by
7676 chaplains.
7777 SECTION 3. Each board of trustees of a school district and
7878 each governing body of an open-enrollment charter school shall take
7979 a record vote not later than six months after the effective date of
8080 this Act on whether to adopt a policy authorizing a campus of the
8181 district or school to employ or accept as a volunteer a chaplain
8282 under Chapter 23, Education Code, as added by this Act.
8383 SECTION 4. This Act applies beginning with the 2023-2024
8484 school year.
8585 SECTION 5. This Act takes effect immediately if it receives
8686 a vote of two-thirds of all the members elected to each house, as
8787 provided by Section 39, Article III, Texas Constitution. If this
8888 Act does not receive the vote necessary for immediate effect, this
8989 Act takes effect September 1, 2023.
