55 relating to emergency possession of certain abandoned children by
66 designated emergency infant care providers.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 262.301, Family Code, is amended by
99 amending Subdivision (1) and adding Subdivisions (3) and (4) to
1010 read as follows:
1111 (1) "Designated emergency infant care provider"
1212 means:
1313 (A) an emergency medical services provider;
1414 (B) a hospital;
1515 (C) a freestanding emergency medical care
1616 facility licensed under Chapter 254, Health and Safety Code; [or]
1717 (D) a child-placing agency licensed [by the
1818 Department of Family and Protective Services] under Chapter 42,
1919 Human Resources Code, that:
2020 (i) agrees to act as a designated emergency
2121 infant care provider under this subchapter; and
2222 (ii) has on staff a person who is licensed
2323 as a registered nurse under Chapter 301, Occupations Code, or who
2424 provides emergency medical services under Chapter 773, Health and
2525 Safety Code, and who will examine and provide emergency medical
2626 services to a child taken into possession by the agency under this
2727 subchapter; or
2828 (E) a fire department.
2929 (3) "Fire department" means a department of a local
3030 government that is organized to prevent or suppress fires and is
3131 staffed 24 hours a day by employees of the local government.
3232 (4) "Newborn safety device" means a device installed
3333 by a designated emergency infant care provider in compliance with
3434 Section 262.3025.
3535 SECTION 2. Section 262.302(a), Family Code, is amended to
3636 read as follows:
3737 (a) A designated emergency infant care provider shall,
3838 without a court order, take possession of a child who appears to be
3939 60 days old or younger if:
4040 (1) the child is voluntarily delivered to the provider
4141 by the child's parent by:
4242 (A) leaving the child with an employee of the
4343 provider; or
4444 (B) placing the child in a newborn safety device
4545 located inside the provider's facilities; and
4646 (2) the parent did not express an intent to return for
4747 the child.
4848 SECTION 3. Subchapter D, Chapter 262, Family Code, is
4949 amended by adding Section 262.3025 to read as follows:
5050 Sec. 262.3025. NEWBORN SAFETY DEVICE. (a) A designated
5151 emergency infant care provider may place a newborn safety device
5252 inside the provider's facilities to take possession of a child
5353 under Section 262.302.
5454 (b) A newborn safety device installed by a designated
5555 emergency infant care provider must:
5656 (1) be physically located:
5757 (A) inside a facility that is staffed 24 hours a
5858 day by employees of the provider; and
5959 (B) in an area conspicuous and visible to the
6060 employees of the provider; and
6161 (2) contain an alarm system connected to the device to
6262 audibly notify an employee of the provider that a child has been
6363 placed in the device.
6464 (c) A designated emergency infant care provider that places
6565 a newborn safety device in the provider's facilities shall develop
6666 procedures to regularly verify that the device's alarm system is in
6767 working order.
6868 SECTION 4. This Act takes effect September 1, 2023.
