| 7 | 7 | | relating to the authority of a municipality or county to regulate |

| 8 | 8 | | the use of an appliance, system, or component that is fueled by |

| 9 | 9 | | natural gas or propane. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 250, Local Government Code, is amended |
|---|
| 12 | 12 | | by adding Section 250.014 to read as follows: |
|---|
| 13 | 13 | | Sec. 250.014. CERTAIN REGULATIONS OF NATURAL GAS OR PROPANE |
|---|
| 14 | 14 | | APPLIANCES PROHIBITED. (a) A municipality or county may not adopt |
|---|
| 15 | 15 | | or enforce an ordinance, order, or other regulation that prohibits |
|---|
| 16 | 16 | | or restricts, directly or indirectly, the use of an appliance, |
|---|
| 17 | 17 | | system, or component that is fueled by natural gas or propane in the |
|---|
| 18 | 18 | | construction, renovation, maintenance, or alteration of a |
|---|
| 19 | 19 | | residential or commercial building. |
|---|
| 20 | 20 | | (b) This section does not prohibit a municipality or county |
|---|
| 21 | 21 | | from using an appliance, system, or component powered by any energy |
|---|
| 22 | 22 | | source on property owned by the municipality or county. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect September 1, 2023. |
