44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to academic distinction designations under the public
77 school accountability system and the career and technology
88 allotment under the Foundation School Program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 39.202, Education Code, is amended to
1111 read as follows:
1212 Sec. 39.202. ACADEMIC DISTINCTION DESIGNATION FOR
1313 DISTRICTS AND CAMPUSES. The commissioner by rule shall establish
1414 an academic distinction designation for districts and campuses for
1515 outstanding performance in attainment of postsecondary readiness.
1616 The commissioner shall adopt criteria for the designation under
1717 this section, including:
1818 (1) percentages of students who:
1919 (A) performed satisfactorily, as determined
2020 under the college readiness performance standard under Section
2121 39.0241, on assessment instruments required under Section
2222 39.023(a), (b), (c), or (l), aggregated across grade levels by
2323 subject area; or
2424 (B) met the standard for annual improvement, as
2525 determined by the agency under Section 39.034, on assessment
2626 instruments required under Section 39.023(a), (b), (c), or (l),
2727 aggregated across grade levels by subject area, for students who
2828 did not perform satisfactorily as described by Paragraph (A);
2929 (2) percentages of:
3030 (A) students who earned a nationally or
3131 internationally recognized business or industry certification or
3232 license;
3333 (B) students who completed a coherent sequence of
3434 career and technical courses;
3535 (C) students who completed a dual credit course
3636 or an articulated postsecondary course provided for local credit;
3737 (D) students who achieved applicable College
3838 Readiness Benchmarks or the equivalent on the Preliminary
3939 Scholastic Assessment Test (PSAT), the Scholastic Assessment Test
4040 (SAT), the American College Test (ACT), or the ACT-Plan assessment
4141 program; [and]
4242 (E) students who received a score on either an
4343 advanced placement test or an international baccalaureate
4444 examination to be awarded college credit; and
4545 (F) students who completed a Pathways in
4646 Technology Early College High School (P-TECH) program established
4747 under Subchapter N, Chapter 29, or another early college high
4848 school program; and
4949 (3) other factors for determining sufficient student
5050 attainment of postsecondary readiness.
5151 SECTION 2. Section 48.106(a-1), Education Code, is amended
5252 to read as follows:
5353 (a-1) In addition to the amounts under Subsection (a), for
5454 each student in average daily attendance, a district is entitled to
5555 $150 [$50] for each of the following in which the student is
5656 enrolled:
5757 (1) a campus designated as a P-TECH school under
5858 Section 29.556; or
5959 (2) a campus that is a member of the New Tech Network
6060 and that focuses on project-based learning and work-based
6161 education.
6262 SECTION 3. This Act applies beginning with the 2023-2024
6363 school year.
6464 SECTION 4. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2023.
