8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

9 | 9 | | SECTION 1. Section 252.301(d), Transportation Code, is |
---|
10 | 10 | | amended to read as follows: |
---|
11 | 11 | | (d) Except as provided by Section 252.3011, a [A] county |
---|
12 | 12 | | that votes to adopt this subchapter may vote in the same manner to |
---|
13 | 13 | | discontinue use of this subchapter. |
---|
14 | 14 | | SECTION 2. Subchapter D, Chapter 252, Transportation Code, |
---|
15 | 15 | | is amended by adding Section 252.3011 to read as follows: |

16 | 16 | | Sec. 252.3011. DISCONTINUATION OF COUNTY ROAD DEPARTMENT |
---|
17 | 17 | | SYSTEM IN CERTAIN COUNTIES. (a) This section applies only to a |
---|
18 | 18 | | county with a population of less than 75,000 that is adjacent to |
---|
19 | 19 | | three counties with populations of more than 450,000. |
---|
20 | 20 | | (b) The commissioners court of a county that has voted to |
---|
21 | 21 | | adopt this subchapter may discontinue the use of this subchapter by |
---|
22 | 22 | | an order made at a regular term of the court. |
---|
23 | 23 | | (c) The commissioners court shall enter the order in its |
---|
24 | 24 | | minutes. The order is not required to be in any particular form, |
---|
25 | 25 | | and substantial compliance with this section is sufficient. |
---|
26 | 26 | | (d) If the commissioners court discontinues the use of this |
---|
27 | 27 | | subchapter, Subchapter B applies to the county. |
---|
28 | 28 | | SECTION 3. This Act takes effect September 1, 2023. |
