55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to persons authorized to conduct a marriage ceremony.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Sections 2.202(a) and (b), Family Code, are
1010 amended to read as follows:
1111 (a) The following persons are authorized to conduct a
1212 marriage ceremony:
1313 (1) a licensed or ordained Christian minister or
1414 priest;
1515 (2) a Jewish rabbi;
1616 (3) a person who is an officer of a religious
1717 organization and who is authorized by the organization to conduct a
1818 marriage ceremony; and
1919 (4) a current, former, or retired federal judge or
2020 state judge [justice of the supreme court, judge of the court of
2121 criminal appeals, justice of the courts of appeals, judge of the
2222 district, county, and probate courts, judge of the county courts at
2323 law, judge of the courts of domestic relations, judge of the
2424 juvenile courts, retired justice or judge of those courts, justice
2525 of the peace, retired justice of the peace, judge of a municipal
2626 court, retired judge of a municipal court, associate judge of a
2727 statutory probate court, retired associate judge of a statutory
2828 probate court, associate judge of a county court at law, retired
2929 associate judge of a county court at law, or judge or magistrate of
3030 a federal court of this state; and
3131 [(5) a retired judge or magistrate of a federal court
3232 of this state].
3333 (b) For the purposes of Subsection (a)(4), "federal judge"
3434 and "state judge" have the meanings assigned by Section 25.025, Tax
3535 Code [a retired judge or justice is a former judge or justice who is
3636 vested in the Judicial Retirement System of Texas Plan One or the
3737 Judicial Retirement System of Texas Plan Two or who has an aggregate
3838 of at least 12 years of service as judge or justice of any type
3939 listed in Subsection (a)(4)].
4040 SECTION 2. Section 2.202(b-1), Family Code, is repealed.
4141 SECTION 3. This Act takes effect September 1, 2023.
