| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 33.083(b), Education Code, is amended to |
|---|
| 12 | 12 | | read as follows: |
|---|
| 13 | 13 | | (b) The University Interscholastic League is a part of the |
|---|
| 14 | 14 | | agency [The University of Texas at Austin] and must submit its rules |
|---|
| 15 | 15 | | and procedures to the commissioner for approval or disapproval. |
|---|
| 16 | 16 | | The funds belonging to the University Interscholastic League shall |
|---|
| 17 | 17 | | be deposited with the agency [The University of Texas at Austin] for |
|---|
| 18 | 18 | | the benefit of the league and shall be subject to audits by [The |
|---|
| 19 | 19 | | University of Texas at Austin, The University of Texas System, and] |
|---|
| 20 | 20 | | the state auditor. Copies of annual audits shall be furnished, on |
|---|
| 21 | 21 | | request, to members of the legislature. |
|---|
| 22 | 22 | | SECTION 2. Section 67.26, Education Code, is transferred to |
|---|
| 23 | 23 | | Subchapter D, Chapter 33, Education Code, and redesignated as |
|---|
| 24 | 24 | | Section 33.0835, Education Code, to read as follows: |
|---|
| 25 | 25 | | Sec. 33.0835 [67.26]. UNIVERSITY INTERSCHOLASTIC LEAGUE; |
|---|
| 26 | 26 | | VENUE FOR SUITS. Venue for suits brought against the University |
|---|
| 27 | 27 | | Interscholastic League or for suits involving the interpretation or |
|---|
| 28 | 28 | | enforcement of the rules or regulations of the University |
|---|
| 29 | 29 | | Interscholastic League shall be in Travis County, Texas. When the |
|---|
| 30 | 30 | | litigation involves a school district located within Travis County, |
|---|
| 31 | 31 | | it shall be heard by a visiting judge. |
|---|
| 32 | 32 | | SECTION 3. (a) On September 1, 2023, the University |
|---|
| 33 | 33 | | Interscholastic League is transferred from The University of Texas |
|---|
| 34 | 34 | | at Austin to the Texas Education Agency in accordance with this Act. |
|---|
| 35 | 35 | | (b) All forms, rules, and procedures of the University |
|---|
| 36 | 36 | | Interscholastic League that relate to extracurricular activities |
|---|
| 37 | 37 | | in public schools and that are in effect on September 1, 2023, |
|---|
| 38 | 38 | | continue in effect. Any proceeding pending on the effective date of |
|---|
| 39 | 39 | | this Act is continued without change in status after the effective |
|---|
| 40 | 40 | | date of this Act. |
|---|
| 41 | 41 | | (c) All records of the University Interscholastic League |
|---|
| 42 | 42 | | relating to extracurricular activities in public schools are |
|---|
| 43 | 43 | | transferred from The University of Texas at Austin to the Texas |
|---|
| 44 | 44 | | Education Agency. Other assets of the league shall also be |
|---|
| 45 | 45 | | transferred to the agency unless the asset was acquired at the |
|---|
| 46 | 46 | | expense of The University of Texas at Austin, in which case the |
|---|
| 47 | 47 | | asset shall be transferred to the university. |
|---|
| 48 | 48 | | (d) An employee working for the University Interscholastic |
|---|
| 49 | 49 | | League at The University of Texas at Austin becomes an employee of |
|---|
| 50 | 50 | | the University Interscholastic League at the Texas Education |
|---|
| 51 | 51 | | Agency. |
|---|
| 52 | 52 | | SECTION 4. This Act takes effect September 1, 2023. |
