77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter C, Chapter 161, Agriculture Code, is
99 amended by adding Section 161.0542 to read as follows:
1010 Sec. 161.0542. NOTICE OF WILDLIFE DISEASE OUTBREAK. (a)
1111 Notwithstanding any law restricting the disclosure of information
1212 by the commission and subject to Subsection (b), if the commission
1313 becomes aware of a wildlife disease outbreak on a property, the
1414 commission shall provide notice of the location and nature of the
1515 outbreak to:
1616 (1) each owner of adjacent property; and
1717 (2) the Parks and Wildlife Department.
1818 (b) Subsection (a) applies only to a disease that the
1919 commission has designated as reportable.
2020 SECTION 2. Section 11.030(a), Parks and Wildlife Code, is
2121 amended to read as follows:
2222 (a) The name and address and a telephone, social security,
2323 driver's license, bank account, credit card, or charge card number
2424 of a person who purchases customer products, licenses, or services
2525 from the department may not be disclosed, sold, rented, or traded
2626 except as authorized under this section or Section 12.014, 12.103,
2727 or 12.0251.
2828 SECTION 3. Subchapter A, Chapter 12, Parks and Wildlife
2929 Code, is amended by adding Section 12.014 to read as follows:
3030 Sec. 12.014. NOTICE OF WILDLIFE DISEASE OUTBREAK. (a)
3131 Notwithstanding any law restricting the disclosure of information
3232 by the department and subject to Subsection (b), if the department
3333 becomes aware of a wildlife disease outbreak on a property, the
3434 department shall provide notice of the location and nature of the
3535 outbreak to:
3636 (1) each owner of adjacent property; and
3737 (2) the Texas Animal Health Commission.
3838 (b) Subsection (a) applies only to a disease that the Texas
3939 Animal Health Commission has designated as reportable.
4040 SECTION 4. Section 12.0251(b), Parks and Wildlife Code, is
4141 amended to read as follows:
4242 (b) The commission or the department may disclose
4343 information described by this section only to:
4444 (1) the landowner;
4545 (2) another person if [unless:
4646 [(1)] the landowner consents to full or specified
4747 partial disclosure of information[;] and
4848 [(2)] the consent is in writing and is attached to the
4949 plan or recommendation report; or
5050 (3) the Texas Animal Health Commission as needed to
5151 carry out a governmental purpose.
5252 SECTION 5. Section 12.103, Parks and Wildlife Code, is
5353 amended by amending Subsections (b) and (c) and adding Subsection
5454 (d-1) to read as follows:
5555 (b) Except as provided by Subsection (d) or (d-1), the
5656 department may use information collected by an employee of the
5757 department on privately owned land only for the purposes of
5858 scientific investigations and research described in Subsection (a)
5959 and only if authorized in writing by the landowner or the
6060 landowner's agent. Unless the department first obtains the written
6161 consent of the landowner or the landowner's agent, the department
6262 may not:
6363 (1) use other incidental information obtained on the
6464 land that does not pertain directly to the investigation or
6565 research authorized under Subsection (a); or
6666 (2) enter or permit the entry of any information that
6767 does not pertain directly to the investigation or research
6868 authorized under Subsection (a), into a database:
6969 (A) maintained by the department and available to
7070 a person other than a department employee;
7171 (B) maintained by a natural heritage program
7272 administered by the department; or
7373 (C) established and maintained by any other
7474 person.
7575 (c) Except as provided by Subsection (d) or (d-1),
7676 information collected under this section may only be reported or
7777 compiled in a manner that prevents the identification of an
7878 individual parcel or specific parcels of private property without
7979 the written consent of the landowner or the landowner's agent.
8080 (d-1) The department may disclose information collected
8181 under this section to the Texas Animal Health Commission as needed
8282 to carry out a governmental purpose.
8383 SECTION 6. This Act takes effect immediately if it receives
8484 a vote of two-thirds of all the members elected to each house, as
8585 provided by Section 39, Article III, Texas Constitution. If this
8686 Act does not receive the vote necessary for immediate effect, this
8787 Act takes effect September 1, 2023.
