| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 181.102, Health and Safety Code, is |
|---|
| 11 | 11 | | amended by adding Subsection (d) to read as follows: |
|---|
| 12 | 12 | | (d) A covered entity that restricts through an electronic |
|---|
| 13 | 13 | | health records system a parent's access to the electronic health |
|---|
| 14 | 14 | | records of a child who is 13 years of age or older must notify the |
|---|
| 15 | 15 | | parent in writing that the parent may access the child's records by |
|---|
| 16 | 16 | | contacting the covered entity. The covered entity shall: |
|---|
| 17 | 17 | | (1) provide the notification every six months; and |
|---|
| 18 | 18 | | (2) include in the notification the telephone number, |
|---|
| 19 | 19 | | e-mail address, and mailing address of the division of the covered |
|---|
| 20 | 20 | | entity that maintains the records. |
|---|
| 21 | 21 | | SECTION 2. This Act takes effect September 1, 2023. |
