66 AN ACT
77 relating to inservice training on identifying abuse, neglect, and
88 illegal, unprofessional, and unethical conduct in certain health
99 care facilities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 161.133(a), Health and Safety Code, is
1212 amended to read as follows:
1313 (a) The executive commissioner by rule shall require each
1414 inpatient mental health facility, treatment facility, or hospital
1515 that provides comprehensive medical rehabilitation services to
1616 annually provide as a condition of continued licensure a minimum of
1717 eight hours of initial inservice training for new employees and
1818 four hours of continuing inservice training for continuing
1919 employees that is designed to assist employees and health care
2020 professionals associated with the facility in identifying patient
2121 abuse or neglect and illegal, unprofessional, or unethical conduct
2222 by or in the facility.
2323 SECTION 2. Section 161.133(a), Health and Safety Code, as
2424 amended by this Act, applies to the minimum number of inservice
2525 training hours provided as a condition of licensure by health care
2626 facilities subject to that section on and after the effective date
2727 of this Act. The minimum number of inservice training hours
2828 provided before the effective date of this Act is governed by the
2929 law in effect immediately before the effective date of this Act, and
3030 the former law is continued in effect for that purpose.
3131 SECTION 3. This Act takes effect September 1, 2023.
