7 | 7 | | relating to inservice training on identifying abuse, neglect, and |

8 | 8 | | illegal, unprofessional, and unethical conduct in certain health |
---|
9 | 9 | | care facilities. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 161.133(a), Health and Safety Code, is |
---|
12 | 12 | | amended to read as follows: |

13 | 13 | | (a) The executive commissioner by rule shall require each |
---|
14 | 14 | | inpatient mental health facility, treatment facility, or hospital |
---|
15 | 15 | | that provides comprehensive medical rehabilitation services to |
---|
16 | 16 | | annually provide as a condition of continued licensure a minimum of |
---|
17 | 17 | | eight hours of initial inservice training for new employees and |
---|
18 | 18 | | four hours of continuing inservice training for continuing |
---|
19 | 19 | | employees that is designed to assist employees and health care |
---|
20 | 20 | | professionals associated with the facility in identifying patient |
---|
21 | 21 | | abuse or neglect and illegal, unprofessional, or unethical conduct |
---|
22 | 22 | | by or in the facility. |
---|
23 | 23 | | SECTION 2. Section 161.133(a), Health and Safety Code, as |
---|
24 | 24 | | amended by this Act, applies to the minimum number of inservice |
---|
25 | 25 | | training hours provided as a condition of licensure by health care |
---|
26 | 26 | | facilities subject to that section on and after the effective date |
---|
27 | 27 | | of this Act. The minimum number of inservice training hours |
---|
28 | 28 | | provided before the effective date of this Act is governed by the |
---|
29 | 29 | | law in effect immediately before the effective date of this Act, and |
---|
30 | 30 | | the former law is continued in effect for that purpose. |
---|
31 | 31 | | SECTION 3. This Act takes effect September 1, 2023. |
