| 6 | 6 | | relating to health benefit coverage for bariatric surgery under the |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 1551.225(a), Insurance Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (a) The board of trustees shall develop a cost-neutral or |
|---|
| 12 | 12 | | cost-positive plan for providing under the group benefits program |
|---|
| 13 | 13 | | bariatric surgery coverage for: |
|---|
| 14 | 14 | | (1) employees eligible to participate in the program |
|---|
| 15 | 15 | | under Section 1551.101; |
|---|
| 16 | 16 | | (2) annuitants eligible to participate in the program |
|---|
| 17 | 17 | | under Section 1551.102; and |
|---|
| 18 | 18 | | (3) former state employees eligible to participate in |
|---|
| 19 | 19 | | the program under Section 1551.108. |
|---|
| 20 | 20 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 21 | 21 | | to a plan year that commences on or after January 1, 2024. |
|---|
| 22 | 22 | | SECTION 3. This Act takes effect September 1, 2023. |
