5	5	relating to the Texas Child Mental Health Care Consortium.
6	6	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	7	SECTION 1. Section 113.0052, Health and Safety Code, is
8	8	amended to read as follows:
9	9	Sec. 113.0052. COMPOSITION. The consortium is composed
10	10	of:
11	11	(1) the following health-related institutions of
12	12	higher education:
13	13	(A) Baylor College of Medicine;
14	14	(B) Texas A&M University System Health Science
15	15	Center;
16	16	(C) Texas Tech University Health Sciences
17	17	Center;
18	18	(D) Texas Tech University Health Sciences Center
19	19	at El Paso;
20	20	(E) University of North Texas Health Science
21	21	Center at Fort Worth;
22	22	(F) The Dell Medical School at The University of
23	23	Texas at Austin;
24	24	(G) [The University of Texas M.D. Anderson Cancer
25	25	Center;
26	26	[(H)] The University of Texas Medical Branch at
27	27	Galveston;
28	28	(H) [(I)] The University of Texas Health Science
29	29	Center at Houston;
30	30	(I) [(J)] The University of Texas Health Science
31	31	Center at San Antonio;
32	32	(J) [(K)] The University of Texas Rio Grande
33	33	Valley School of Medicine;
34	34	(K) [(L)] The University of Texas Health Science
35	35	Center at Tyler; and
36	36	(L) [(M)] The University of Texas Southwestern
37	37	Medical Center;
38	38	(2) the commission;
39	39	(3) the Texas Higher Education Coordinating Board;
40	40	(4) three nonprofit organizations that focus on mental
41	41	health care, designated by a majority of the members described by
42	42	Subdivision (1); [and]
43	43	(5) each regional education service center
44	44	established under Chapter 8, Education Code, that the executive
45	45	commissioner identifies as a center predominately serving school
46	46	districts classified as rural by the National Center for Education
47	47	Statistics of the United States Department of Education; and
48	48	(6) any other entity that the executive committee
49	49	considers necessary.
50	50	SECTION 2. Section 113.0101(a), Health and Safety Code, is
51	51	amended to read as follows:
52	52	(a) The consortium is governed by an executive committee
53	53	composed of the following members:
54	54	(1) the chair of the academic department of psychiatry
55	55	of each of the health-related institutions of higher education
56	56	listed in Section 113.0052(1) or a licensed psychiatrist, including
57	57	a child-adolescent psychiatrist, designated by the chair to serve
58	58	in the chair's place;
59	59	(2) a representative of the commission with expertise
60	60	in the delivery of mental health care services, appointed by the
61	61	executive commissioner;
62	62	(3) a representative of the commission with expertise
63	63	in mental health facilities, appointed by the executive
64	64	commissioner;
65	65	(4) a representative of the Texas Higher Education
66	66	Coordinating Board, appointed by the commissioner of the
67	67	coordinating board;
68	68	(5) a representative of each nonprofit organization
69	69	described by Section 113.0052(4) that is part of the consortium,
70	70	designated by a majority of the members described by Subdivision
71	71	(1);
72	72	(6) a representative of a hospital system in this
73	73	state, designated by a majority of the members described by
74	74	Subdivision (1); [and]
75	75	(7) a representative selected from among the regional
76	76	education service centers described by Section 113.0052(5),
77	77	appointed by the executive commissioner; and
78	78	(8) any other representative designated:
79	79	(A) under Subsection (b); or
80	80	(B) by a majority of the members described by
81	81	Subdivision (1) at the request of the executive committee.
82	82	SECTION 3. Section 113.0102, Health and Safety Code, is
83	83	amended to read as follows:
84	84	Sec. 113.0102. TERMS; VACANCY. (a) Except as provided by
85	85	Subsection (b), the executive committee shall establish:
86	86	(1) the terms of executive committee members; and
87	87	(2) procedures for the reappointment of members.
88	88	(b) An executive committee member described by Section
89	89	113.0101(a)(7) serves a two-year term and is eligible for
90	90	reappointment.
91	91	(c) A vacancy on the executive committee shall be filled in
92	92	the same manner as the original appointment.
93	93	SECTION 4. This Act takes effect September 1, 2023.
