55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the consideration of ownership interests of certain
88 persons in determining whether a business is a historically
99 underutilized business for purposes of state contracting.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 2161.001(3), Government Code, is amended
1212 to read as follows:
1313 (3) "Economically disadvantaged person" means a
1414 person who:
1515 (A) is economically disadvantaged because of the
1616 person's identification as a member of a certain group, including:
1717 (i) Black Americans;
1818 (ii) Hispanic Americans;
1919 (iii) women;
2020 (iv) Asian Pacific Americans;
2121 (v) Native Americans; [and]
2222 (vi) veterans as defined by 38 U.S.C.
2323 Section 101(2) who have suffered at least a 20 percent
2424 service-connected disability as defined by 38 U.S.C. Section
2525 101(16);
2626 (vii) persons with a disability as defined
2727 by 42 U.S.C. Section 12102; and
2828 (viii) persons who identify as one or more
2929 of the following sexual orientations or gender identities:
3030 (a) gay;
3131 (b) lesbian;
3232 (c) bisexual;
3333 (d) transgender;
3434 (e) queer;
3535 (f) intersex; or
3636 (g) asexual; and
3737 (B) has suffered the effects of discriminatory
3838 practices or other similar insidious circumstances over which the
3939 person has no control.
4040 SECTION 2. Section 2161.002, Government Code, is amended by
4141 adding Subsection (e) to read as follows:
4242 (e) The comptroller shall adopt rules to provide goals for
4343 increasing the contract awards for the purchase of goods or
4444 services by the comptroller and other state agencies to businesses
4545 that qualify as historically underutilized businesses because the
4646 businesses are at least 51 percent owned or owned, operated, and
4747 controlled, as required by Section 2161.001(2), by one or more
4848 persons with a disability as defined by 42 U.S.C. Section 12102 or
4949 one or more persons who identify as one or more of the sexual
5050 orientations or gender identities described by Section
5151 2161.001(3)(A)(viii). The goals established under this subsection
5252 are in addition to the goals established under Subsections (c) and
5353 (d), and the goals established under Subsections (c) and (d) may not
5454 be reduced as a result of the establishment of goals under this
5555 subsection.
5656 SECTION 3. Section 2161.061, Government Code, is amended by
5757 adding Subsection (f) to read as follows:
5858 (f) To be certified by the comptroller as a historically
5959 underutilized business, a business owned by one or more persons who
6060 qualify as economically disadvantaged solely based on being a
6161 person with a disability as defined by 42 U.S.C. Section 12102 must
6262 submit to the comptroller an affidavit from a physician licensed to
6363 practice medicine in this state for each owner claiming a
6464 disability verifying that owner's disability.
6565 SECTION 4. Section 2161.125, Government Code, is amended to
6666 read as follows:
6767 Sec. 2161.125. CATEGORIZATION OF HISTORICALLY
6868 UNDERUTILIZED BUSINESSES. The comptroller, in cooperation with
6969 each state agency reporting under this subchapter, shall categorize
7070 each historically underutilized business included in a report under
7171 this subchapter by sex, race, and ethnicity and by whether the
7272 business qualifies as a historically underutilized business
7373 because it is owned or owned, operated, and controlled, as
7474 applicable, wholly or partly by one or more persons with a
7575 disability as defined by 42 U.S.C. Section 12102, one or more
7676 persons who identify as one or more of the sexual orientations or
7777 gender identities described by Section 2161.001(3)(A)(viii), or
7878 one or more veterans as defined by 38 U.S.C. Section 101(2) who have
7979 suffered at least a 20 percent service-connected disability as
8080 defined by 38 U.S.C. Section 101(16).
8181 SECTION 5. This Act takes effect September 1, 2023.
