| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter A, Chapter 301, Property Code, is |
|---|
| 10 | 10 | | amended by adding Section 301.0045 to read to read as follows: |

| 11 | 11 | | Sec. 301.0045. DISCRIMINATION BASED ON HAIR TEXTURE OR |
|---|
| 12 | 12 | | PROTECTIVE HAIRSTYLE OR COVERINGS. (a) In this section, |
|---|
| 13 | 13 | | "protective hairstyle or coverings" means a hairstyle, facial hair |
|---|
| 14 | 14 | | style, or head covering necessitated by, or resulting from, the |
|---|
| 15 | 15 | | characteristics of a hair texture, hairstyle, facial hair style, or |
|---|
| 16 | 16 | | head covering commonly associated with race, religion, national |
|---|
| 17 | 17 | | origin, ethnicity, or culture, and includes but is not limited to |
|---|
| 18 | 18 | | afros, bantu knots, braids, burqas, cornrows, curls, locs, |
|---|
| 19 | 19 | | headscarves, hijabs, pagri, twits, or hair that is tightly coiled |
|---|
| 20 | 20 | | or tightly curled. |

| 21 | 21 | | (b) A provision in this chapter, other than a provision in |
|---|
| 22 | 22 | | Subchapter I, referring to discrimination because of or on the |
|---|
| 23 | 23 | | basis of race, color, religion, national origin, ethnicity, or on |
|---|
| 24 | 24 | | includes discrimination because of or on the basis of a person's |
|---|
| 25 | 25 | | hair texture or protective hairstyle commonly or historically |
|---|
| 26 | 26 | | associated with race, religion, national origin, ethnicity, or |
|---|
| 27 | 27 | | culture. |
|---|
| 28 | 28 | | SECTION 2. Section 301.0045, Property Code, as added by |
|---|
| 29 | 29 | | this Act, applies only to a discriminatory housing practice that |
|---|
| 30 | 30 | | occurs on or after the effective date of this Act. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2023. |
