| 8 | 8 | | United States from consideration for purposes of the indicators of |

| 9 | 9 | | achievement under the public school accountability system. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 39.053, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (c-5) to read as follows: |
|---|
| 13 | 13 | | (c-5) A student not lawfully present in the United States |
|---|
| 14 | 14 | | may not be included in evaluating school district and campus |
|---|
| 15 | 15 | | performance on the achievement indicators adopted under Subsection |
|---|
| 16 | 16 | | (c) and may be considered only as necessary to comply with |
|---|
| 17 | 17 | | applicable federal accountability reporting requirements. |
|---|
| 18 | 18 | | SECTION 2. This Act applies beginning with the 2023-2024 |
|---|
| 19 | 19 | | school year. |
|---|
| 20 | 20 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 21 | 21 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 22 | 22 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 23 | 23 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 24 | 24 | | Act takes effect September 1, 2023. |
