55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the exclusion of students not lawfully present in the
88 United States from consideration for purposes of the indicators of
99 achievement under the public school accountability system.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 39.053, Education Code, is amended by
1212 adding Subsection (c-5) to read as follows:
1313 (c-5) A student not lawfully present in the United States
1414 may not be included in evaluating school district and campus
1515 performance on the achievement indicators adopted under Subsection
1616 (c) and may be considered only as necessary to comply with
1717 applicable federal accountability reporting requirements.
1818 SECTION 2. This Act applies beginning with the 2023-2024
1919 school year.
2020 SECTION 3. This Act takes effect immediately if it receives
2121 a vote of two-thirds of all the members elected to each house, as
2222 provided by Section 39, Article III, Texas Constitution. If this
2323 Act does not receive the vote necessary for immediate effect, this
2424 Act takes effect September 1, 2023.
